Help Needed Please - Reclaiming Abbey Charges

Hi Folks

I wonder whether anyone could help me please.

I requested the statements for the last 6 years from Abbey. They have sent me copies of transactional statements from 01/01/07 until the account was closed on 23/09/08. Separately, they have sent me a schedule of summarised charges going back to January 2003.

I have a couple of questions:

1. Can I now use the schedule and details from the copy 07/08 statements to calculate the total charges I wish to claim;

OR

2. Do I need ALL copy transactional statements (not a summary of charges) before trying to proceed with a claim.

Thanks in advance for any help/assistance you might be able to give me.

  • Hi

I got the same information from Abbey when I started my claim, I used this to form my claim by highlighting every charge. Then filled in the interest calculation sheet on the website this then gives you a total of charges and interest which you can print off and send with your claim.

This was back in 2007, they did not pay so I had to take them to court, unfortunately OFT test case started before my court date and it is now on hold.

But this should be enough information to make your claim, good luck.

  • Hi, thank you for your quick response.

We are currently in a DMP with CCCS and I was hoping to reclaim the bank charges to "repay" the overdraft outstanding with the Abbey which is included in the plan. I dont know if anyone has successfully managed to do anything similar.

I was hoping to be able to bring it to an earlier conclusion under the hardship criteria (OH failed business/having to take lower paid job etc).

I suppose I can only try!

    Thanks again for your help.

We have successfully managed to do exactly that (also on a DMP).

If you are on a DMP then you must be, by definition, in financial hardship, and so you claim should be dealt with straightaway. Make sure you don't make yourselves look too well off in the income and expenditure questionnaire that they will send you.

    Good luck.
  • Hi MC

Thanks for sharing that information. Were you with CCCS (or similar) because I was wondering when the time comes whether you just use the same budget plan as agreed with them?

I soooo long for the day when we can feel truly "well off" - for the moment I just have to feel grateful that we're managing to keep a roof over our heads etc.

Your post has given me hope that perhaps we will have one less creditor on the list in the not too distant future. Thank you. :D
