Zurich New Build Insurance Excess

Hi,

I have made a cliam on the new build insurance for my flat which Zurich have agreed to with an excess of £1000.

I have a lease on the flat but own a share(1/6) of the company that owns the freehold. Since the repairs are to windows seals and the damp and plaster damage casued by the leaking I am trying to access the sink fund that the company holds as these are material faults with the building.

However the director of the company, my neighbour, will not authorise access to the money as she says it is only for communal repairs and my claim to Zurich is only for my own flat. Could we widen the claim to include all flats as they have similar problems?

Do I have rights to access this money?
