What should I do now ???

Hi,

A year ago I tried to claim back overcharges from Citi, Halifax and Capital One credit cards.

I sent all 3 template letters with highlighted copies of my statements and had the usual fob of responses back, I was just starting court action but work commitments put a stop to it.

Now should I start again or go straight in with court action.

  • I used the Financial Ombudsman using all the excellent advise on this website, even tells you how to fill out the form - they were a bit slow but got results for claim against Capital One. I think as long as you've had a final response from them you don't need start again.

    Send them one final reminder with the 14 days LBA. Make them aware of the previous years correspondence and schedule of charges. At the end of the day, you have to show that you have tried to settle this before filling a claim at court. If they do not respond then the court route is open to you.

    id just add that the FOS will not normally respond if the deadlock letter is more than 6 months old. the courts however will and if these are all credit cards there is no stay on these claims most paying up in full with interest before getting to court.
