Hello, advice sought

    Got a letter through from Barclays today saying YOU ARE VERY OVERDRAWN DANGER DANGER! all the usual stuff DO NOT IGNORE THIS LETTER!

    What should I do? I've sent them everything they have asked for from the cccs (budget sheet, token payment letter for the token payments i've been making monthly since november). They keep sendfing them back asking for extra information. The last lot I sent out was yesterday after they decided that knowing my name, address, cccs number and bank account number wasn't enough and that i needed to send it all in again with my sort code too.
    I've now done that and now I get this letter. What should I do with it? Ignore it? Ring them up and tell them i've sent them what they want and hope they have received it (took them two months to process the first toeken payment letter+budget I sent).

    This is really getting very difficult to deal with.

    Just got a letter from Barclays saying they won't accept my repayment offer. They are going to send me (as per, apparently, the Consumer Credit act 1974) a Termination Notice and pass on the debt to an 'agent appointed by the bank'.

    I can't handle this at all. The thought of some bruiser turning up at my doorstep - at any time (which now means i can't go out) - demanding money is more than i can handle. I have mental health problems and this !!!! i can't deal with. I have tried eveyt which way to be reasonable with the bank. I've done everything the CCCS told me to do and no one is listening. What do i do now?

    Firstly they they cannot turn up, under the rules. Secondly, one DCa has been severely boolocked today for their behaviour and you need to realise that the OFT will now go for DCas who haress people with mental health issues.

    I appreciate the response, but it seems to me what the law says and what these peopel will tryand get away with is something else entirely. I live with my mother who doesn't know I've been dealing with this debt (which needn't have been a problem but for the bank); god forbid they turn up because she is the sort of person unfortunately who would fall for their nonsense and open the door.

    Stuff like that is what concerns me.

    let's start by reading what has been reported about 1st crudit today

    Link: OFT imposes requirements on 1st Credit over debt collection practices

    It is worth down loading the PDF as it is directly relevent to your case.

    Then we can go onto to specific issues - like there is a letter you can write removing the common law right to access to you property.

    That means as long as you do not get to the bailiff stage, you are OK.

    It's for you to use the law to your advantage and report any creditor that has breached it.

    I realise there are legal implications for debt collectors doing what they shouldn't. But that doesn't mean they don't (and probably won't stop them anyway).

  • Wishface, I have an overdraft with Barclays which is around £3000 now (after they kept adding charges)

    There's no way I could pay that, so it has gone to a debt collection agency (after going to Mercers) now. Once they wrote to me, I offered a payment plan in writing, and it was accepted. I found the DCA far easier to deal with than Barclays, at no point have I given a detailed I&E like you have, just a basic one.

    Have you written to Barclays and informed them of your mental health issues? In light of the earlier link posted, I wonder whether they may be more lenient.
