HIya,
I just wondered if someone was able to clear something up for me.
I am, well was on Incapacity Benefit from May til November last year til they stopped it as they said that I was fit for work. While you are on Incapacity Benefit you are able to work upto 16 hours arent you? There is no way that I would be able to work more than 16 hours.
I guess what I am trying to say is that in stopping my Incapacity benefit are they saying that I am capable of doing more than 16 hours work?
Thanks

The PERMITTED WORK RULES are here.
However the Decision Maker has decided that you are capable of work and so that could mean any length of time.
You can appeal the decision and either claim JSA or Income Support as if you were actively seeking work. Most JSA decision makers will allow you to make reasonable conditions on the type of work you are seeking because of your health condition while you are waiting for your appeal to be held. If you win your appeal your benefits will be backdated so you get what you would have been entitled to in total, however if you do actually work part-time while appealing that your are incapable of work you may lose entitlement to benefit even if you win your appeal. My weight loss following Doktor Dahlqvist' Dietary Program

That sounds about right, I think the 16 hr rule is that you are so incapacitated that you couldn't manage more than 16hrs because of your illness.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

So when they stopped my IB back in November they were in effect saying that they thought that I was capable of working more than 16 hours per week?Weight Loss - 102lb0
