Joint Bank Account

Pollik

My daughter is separating from her husband and when she went in to tell the bank, it blocked their joint account. Even when my daughter told the bank that she needed some of the money for her and her 5yr old daughter to live on, the bank refused to budge.
Does anyone know what the legal position is, here, or where my daughter can find out without cost?
(In the meantime, my daughter has taken the begging bowl to the DSS for an emergency payment to tide her over.)

She'll be lucky to get anything from the DSS ... they don't even exist any more

Sorry if it looks like I have sense of humour bypass, but this is serious - my daughter has about £1 in her purse to feed her daughter and herself.
Back to the question - does anyone have any idea about the joint bank account situation, please?

I find it unusual that the bank have frozen the account - the usual complaints around here is that the bank hasn't frozen the account and the other half has withdrawn all the money, taken it into overdraft, and has left it to the poster concerned to pay the debt back.
I'd suggest insisting on talking to the bank manager of the branch concerned, or if you get no joy there, try a local C.A.B.Conjugating the verb 'to be":
-o I am humble -o You are attention seeking -o She is Nadine Dorries0 -
Thank you for your response.
They were my first thoughts, too, but at the time my daughter was so angry, she just stormed out (OK, not the most helpful thing to do). As far as the bank is concerned, she wants to be 'armed' with her rights before she goes in again - she is not a confident person when dealing with 'suits'.
I hope she will see CAB today, but other things (like picking up her daughter from school and dealing with her ex who is still around and about) are getting in the way. I should mention that she lives in a rural location (where the school is), some 10 miles from the town (where the bank, CAB and DSS are). It is not an easy situation for her. Which is why I said I would try and find out what the legal position is, for her.
I have tried Googling, but I can't find the right words to search for without getting all the sales stuff.

you may find the T&Cs of the account on the banks internet site and it may (just may) include what happens in these circumstances.
When she goes back make sure she insists they provide a written copy of their rules dealing with this situation... can't be the first time its happened.
I would image though that the bank would require both to come in and share the proceeds and either close the a/c or transfer to one person.
In any event make sure your daughter opens another account and directs any income she has to the new one. If she has debts or joint debts with the husband then she should ensure the new bank is one she has no debts with.0 -
IIRC a bank may cancel an "either party to instruct manfate" if it is aware of a dispute between the parties concerned, or one gives notice to the bank that the mandate is cancelled. Calapton'sthe bank would require both to come in and share the proceeds and either close the a/c or transfer to one person.0
