is this guy for real?

my sister won an action for an item for £75 and paid immediately.
the auction stated "allow 3 weeks for delivery" which didnt bother her at the time...

when she went to ask him a question about the item, she found he was no longer a registered user.... !!!

luckily she had his email address from his invoice and mailed him.

i told her to make a claim via pay-pal as she only had 4 weeks to do so (advice taken from this site ;) )

she then received a reply a few days later:
he said his ebay account had been suspended following someone mis-using his account.

he said the item was being shipped from america as he spoke, and that the delay was due to his daughter being very ill in hospital.

he said that for her to receive the item she would hav to cancel the paypal claim, if she didnt he would contact the courier and tell them to deliver the item to him instead of her..

he then said that because of her paypal claim, they had frozen his paypal account and he needed the money to buy his daughter's christmas presents....

what should she do?
if she cancels the paypal claim i imagine she wouldnt be able to do another claim for the same item?

the item in question is now only £50 and instock in argos so she is gutted about that anyway, but would obviously honour her ebay "contract" if she receives/received the item...

    Sunflower, tell your sister to ignore the sellers emotional blackmail and stick with the paypal claim.

    The whole story sounds fishy, if she stops the paypal claim she may well be left with nothing.

    Tell her to carry on with the claim!! she won't receive a neg cos he is no longer a user and he is playing on her conscience by saying about his daughter! think about it! if you had a relative who was seriously ill you wouldn't talk about it lightly to a stranger, you would say due to personal reasons etc.....well I would! :(

    Also get her to contact ebay advising them of the situation so she has back up if there is any trouble with paypal.

    Then pop along to argos and buy the item there!!

    the seller can't leave a neg cos he is no longer a reg user so as soon as she has got her money back she should be ok!

    go ahead with claim let him have the item delivered to him by the courier then if you decide to buy the item off him at least you wont have to wait three weeks for it to be shipped over as it will already be in the country if he is a timewaster (which sounds like he is) well no worries as you will be claiming back....

    he's been booted off ebay for a reason, genuine or not, so it will make no difference if you claim as others obiously are!

    unfortunatle nowadays it is very difficult to trust people like this

    ,,,,,,,,,,you could ask for tracking numbers / customs declarations but they are easilly made up, best thing is start your claim a couple of days before the 30 day limit (just o give him chance) and reverse teh claim should the goods show.
