hi Maglincey
You don't have to wait years for a divorce if it was unreasonable behaviour. If you are on benefits or low income, I think you can get legal aid, you can however do it yourself. The divorce can go through quickly if both of you agree. It's the financial stuff that can take longer. Oh and I think NI law is similar uk law. Hope :j this helps"A life spent making mistakes is not only more honorable, but more useful than a life spent doing nothing." George Bernard Shaw:p0 -

If you wan't to do it yourself without a solicitor have a look at this guidance from the NI Court Service:

As long as you have been married more than 2 years you can lodge a divorce petition with the court.:starmod:C'est la vie:starmod:0 -

I'm in N Ireland and divorce laws are slightly different over here. It may have changed in recent years but I had to wait 2 years until I could apply for a divorce and even then I could only get one if my now ex husband agreed to it.
He didnt (just to be awkward) and I had to wait until we had been separated 5 years to get one. After 5 years it doesn't matter(legally) if the other partner contests it. Though even then they are still obliged to serve papers on him several times to allow him the opportunity to give his consent. He again (to be awkward) denied getting them which also wasted time in getting to court.
BTW I applied in July 2006 and didn't get my Decree absolute until Dec 2008 but that did involve a 4-5 month wait for legal aid getting sorted out at the beginning and the ex buggaring about and pretending he either hadn't received the papers or saying he'd signed and posted them when hadn't. If my ex had been more cooperative i'm sure it wouldn't have taken nearly as long as it did.
We had children but no joint property or financial stuff to wrangle over as he has never paid maintainance. In regards to the kids I had to discuss access with the judge on the actual day I went to court and that was very straight forward as I didn't want to impose any restrictions on when he could see the children. How does a brown cow give white milk, when it only eats green grass?0 -
Apologies for resurrecting an old thread but
If my wife and i come to an agreement on a financial settlement ourselves, is there a legal imperative to have it witnessed by a solicitor or can we just produce it in court during divorce proceedings?0
