That default notice is defective, it fails to comply with legislation.

I don't need to see it, but did you receive a termination letter?

Id so, what's the date on it when it was generated?

I'd delete that default imagae now, as it has a barcode showing would could identify you.

For the second loan yes, I am wondering how are we able to stop a forthwith judgement or defend if we don't know whats happening. I did write to the court objecting the forthwith judgement but it didn't get me anywhere.

You can only defend once it's listed for a hearing, fair, no, but that's how the system works I'm afraid

I don't think I've received a termination letter I will look, what happens now then if it is defective? How would I get it set aside?

Thank you so much for taking the time to look into this!

You will need to complete this form (N244) it will cost you £75.00 but if you win, you then put in a counterclaim to the original claimant.

The grounds for setting aside will be not complying with OFT legislation.

It's in your own intrests you try and find any paperwork relating to your a/c being terminated.

I have found the letter stating that the loan agreement has been terminated, a formal demand. Does this change things?

It is dated 11th August 2008

Yes, because you no longer have an agreement with them.

    How come?

Northern Rock have been the worse throughout all of this, they even charged me £64.63 for entering into an IVA! In fact the IVA wasn't even approved so I guess I should query that with them also!

I must query something with you.

    Are you in an IVA?

If so, who with, and how come these debts have not been included within the IVA?
