MBNA calls and text but no CCA

Today MBNA have called me at work and home and have sent an anonymous text to my mobile I googled the number from my mobile and as I expected it was them .

When I got home from work there was a letter asking for a full I and E and a list of all my creditors or otherwise they cant help me and will continue to add interest and charges.

I sent a CCA request which was signed for on 7th Jan so they are just in default I think.
Getting ready to send the next letter and plan to send a harrassment letter.

I am not on a DMP as I have no disposable income .
I have sent MBNA my CCCS client number and 2 token payments which have been cashed.

I dont answer the phone to MBNA or Aegis but do I have to send a full I and E in order to try to get the interest and charrged stopped ?

Do they ever stop adding the charges etc.?

    NO send them nothing.

    What happens is that once they get a CCA request they sometimes pile on the pressure to try and get money out of you before they default.

    have you got a copy of the 12+ 2 day leeter?

    Thanks Ras .. Yes I have a template letter and plan to post tomorrow

    The address I have for MBNA is chester but a PO box , just wondered if that still counts ? I did get electronic proof of delivery of the CCA request .

    This evening I answered landline call ' unavailable number'


    ' Hello ma'am did you receive your free Gazette this week?' I said NO
    he said OK is that Mrs blah blah of blah blah road. I said YES . He said thank you goodbye.


    I thought OH NO :mad: its them again .. why did I answer ?? but then again they know I live here .. dont they ???

    20 mins later landline rang ' unavailable ' I ignored it and within 10 seconds my mobile rang with a typical MBNA / AEGIS call centre number

    I am getting paranoid here and I am definitely sending the harrassment letter tomorrow.

    They were checking your residency because they haven't received any response to letters they've sent.

    I think what's most likely happened here is that they haven't even processed your CCA request yet.

    I agree; time to send the harrassment letter.. If they continue firing letters after the harrassment letter try citing the Malicious Communications Act 1988..

    If they're in default of the CCA request, YOU are the one in the driving seat, not those !!!!!!..

    1) Familiarise yourself and try to learn the OFT debt collection guidelines and section 40 of the Administration of Justice act

    2) Greet their threats of court action, bailiffs, etc.. Tell them you'll see them in court..

    3) If they threaten to send someone round to your house, kindly inform them that you will sue them for tresspass

    4) Ever worked for a really evil manager? Remember the techniques they used to make you feel small? Use them on the collectors.. e.g. after telling them you'll see them in court, stay completely silent and wait for them to speak.. Give them questions rather than answers.. "Why are you contacting me at work in breach of rule 2.2g of the OFT Debt collection guidelines?" "Why are you harrassing me when you are clearly in default under the Consumer Credit Act?"

    5) When at home, stand on a chair to speak to them on the phone

    6) Record all conversations and inform the collectors that their conversations are being recorded..

  • Yay . I have sent letters via recorded delivery to MBNA today
    They must know because only 2 calls so far today ! ..mind you its early yet
    They like to call at 5mins to 9pm just when you think its safe to answer the phone.

    I definitely feel better for sending off those letters :j

    Make sure you check that they have been signed for and refer any other twit to the letter.

    if they do not remove your phone numbers, then report them to the Information Commisioner.
