Hi all,
We have sent a claim using the 1st MSE template to Halifax and they have denied it claiming that "the charges applies are fair" so we are now at stage 2.
This means we can either go for court threat or fast settlement.
My question is - are there any rough guidelines on what banks (specifically HBOS/Lloyds/HBOSLLOYDSTSB/whatever they're called this week) are settling for in hardship cases.
Our claim is for just short of £5k and whilst i'd happily settle for £3k to get us straight, obviously a few extra hundred would be nice -
Any tips/advice gratefully received on this

Would you be happy going into a shop with a £20.00 note & buying a newspaper & then the shop keeper turning round & saying " i know i have to give you x amount back but would you settle for x amount"?
I know i wouldn't.
Stand by your claim. Think about it, while your waiting for your claim, they are making interest on YOUR money they could possibly owe you so why settle for less?0 -
Put the claim in for the full amount, and IF you are suffering financial difficulty (mortgage arrears/co tax arrears/45% drop in income recently etc) then ask them to consider your claim under that criteria.
if they do offer an interim payment to help with hardship, then that will be just that, an interim payment, the remainder of the claim will stand pending the outcome of the test caseLegalBeagles0 -
Hi steve,
I`m in exactly the same position with halifax. I `m going to go for claiming under hardship and see what happens the only thing is i dont know if I have to send anything in to prove your in hardship or I just send letter off stating I am claiming through hardship.
