You would need to follow company grievance procedures before claiming constructive dismissal.
Is there someone in HR that you could discuss your concerns with privately?Gone ... or have I?0 -
I sent you a PM which may help you.
BTW I strongly advise you not to go down the Constructive Dismissal route if you choose a legal option.
Also please go to both Occupational Health and your own GP. This is very important. Stress can cause lots of diseases including fatal ones to flare up which may kill you.I'm not cynical I'm realistic

Are you a member of the Union? In not, just contact the Union anyway, and have a chat. They are very sounding boards.
Very best of luck, it's terrible to be feeling this way. So sorry to hear about it.
Good luck

Hi
I would strongly recommend that you get yourself to your GP and get checked over and if necessary signed off from work (I work in HR and don't usually say that!). Your say yourself you are suffering from stress and this needs to be dealt with first and foremost.
I would also get yourself copies of your companies relevant grievance & bullying and harassment policies and anything else you feel is relevant.
You say you are seeking advice from your Union and I am sure they will be able to guide you through raising a grievance and going through the internal processes before contemplating external resolutions.
Look after your health first and foremost

exactly first thing first, Health!
The obviously from your comments have an issue!, on your own you will not solve this, ACAS will give you advice!
Gather information make notes of dates / times of incidents, as previously mentioned get all the company guidelines ready for the acas/union
There is bound to be an internal griveance procedure to follow.
Look at your comments stay inside and manage it from there, do not get involved with gossup at this stage trust me it will not help (showing your cards)
Good luck, it is a rocky road to go down, but trust me if you keep going and listen and act on the advice you will get through!0 -
Actions to do then:
keep notes. every time something happens that you feel is contributing to this situation note it down in as much detail as possible.
Write out a timeline of what's happened so far, so you can keep track quickly and simply.
start the greviance process with the help of a union rep. you need to be able to pinpoint the problem and who is responsible quite specifically, and provide evidence if you can (hence my first point) . the problem in this case is, categorically, bullying.
Don't take no for an answer. if you struggle to get them to hear your greviance or they whitewash it, appeal. if that doesn't work consider an employment tribunal. incredibly stressfull, but so is what you're going through now.
See your doctor and Occ Health. tell occ health that YOU ARE BEING BULLIED. because that's exactly what is happening. make sure they write it down, and explain to them as clearly as possible the effects of that bullying.
likewise tell the doctor what's happening and get work related stress written into your medical records and on any sick notes. ask if he can refer you to any groups or services for support. you're going to need it if you fight this with them.
keep on the job hunt. it's not a great time for it, but don't give up.
keep records of your performance, particularly when you have excelled or over achieved your targets. keep records of when you have sought help and whether or not it has been forthcoming.
your employer has a responsibility to your health and safety. the health element of that covers both physical and mental health. they are failing in that responsibility. if you can't win a bullying greviance, launch a health and safety greviance and get in touch with the health and safety executive about it. get copies of your health and safety and bullying policies, and a copy of the disciplinary and greivance policy too. read them and if you have any questions give me a shout.
but before you do all of that, and let us know how you're getting on, take a deep breath, make yourself a cuppa, and spend some time with your kid(s). to cope with this kind of stuff you need to learn to let it go when you're not in the office. it's very very hard to do that, but it's so much better for your mental health if you can.

I have read through your notes again,
And you last couple of lines are concerning to me, please seek advice from your GP re-stress not your companies occ-health dept.
What is their day to day interaction with you like?
Concentrate on one thing at a time, if the information you have placed is correct with regards to the way I am reading it, do not put on the additional stress of looking hard for another job!
Do you have performance reviews?
Have you had any disciplinary action/hearings?
All these are questions which you will be asked, and are a judge of your historical performance!
(They probably are scared of you taking their jobs, this is common, just keep your chin up and see your GP!)0 -
