BR Paperwork, OMG!!

Hi All,

I am trying to fill in the paperwork at the moment and am overwhelmed by it and don't really know where to start!!

Can anyone give me some advice. I don't understand the loose sheet bit at all!! After I figure out what is supposed to be written where it also says I have to sign it at a solicitors or court. Do I need to do this before phoning to get my date for BR hearing?

I have recently set up as a childminder, self-employed. It says that if self-employed I have to put all my business details on there and the business will be liquidated or something. I don't want this to happen if at all possible. It is my only source of income, apart from child benefit, which won't get me very far!

I don't know the inception dates or even the account numbers of some of my debts, so no idea what I am going to write down there, but I want to make sure they are all included.

Do I put down my student loan? I know it doesn't get written off, so do I just not put it on?

Also on the SOA bit, my husband pays all the household bills and my income pays for our food bills, baby expenses (nappies etc.), my contact lenses and my mobile phone. Will that be accepted by OR, or will I need to put down our entire household budget. My husband is going to go bankrupt as well, as soon as we can save up another £500!!

Am getting myself in right state about all this, can anyone help or point me in the direction of help?

You are entitled to carry on trading as a sole trader as long as you do so in teh same name you were when you went BR, i

Dont worry abou this, list the debts where needed only if you put "barclaycard" or "hsbc" you can bet the OR knows the address he needs to write to!

  • it is difficult to get your head round. take it slowly and fill the forms in a bit at a time. It has taken me two weeks now and still got blank bits cause I get brain fade.
    From what I have gathered on this board for the couple going bankrupt.
    1. write down all the joint bills as a whole on both forms, rent, gas elec.
    2. split this amount in two so if the houehold bills comes to 1,000 it will be a 1,000 on both.
    3. your own expenses like hair, cars, travel is your own expense and goes on your form as your expense and hubbys on his as his expense.

    I have found sitting down and jigging this about for a bit helps. I found I had to give my partner 600 of my money and vice versa to get it right even though we only bring in 150 each over that.

    I did mine and the OH online. I may not be possible for you, but it gives you a % of how far you've gone. You can always go back and edit, and it saves on the website so you can revisit it.

    I seem to struggle with a load of paper infront of me:o

Do you know if they have a waiting time? Do you know how many copies of your petition you need to take with you.

Every debt up to the date of BR is included even if you miss it off your SoA. That is why it is published in the London Gazette and the paper so that any one with a claim can contact the OR. Just put your nearest best guess on dates.

You put your complete household bills ie mortgage, utilities, council tax. Then your personal bills ie mobile, clothes, car. Then you put your income and in the place where it says 'does any body elde contribute, you put your husbands contribution to the household, Not his full wage as he obviously has his own personal expenses. It should be enough to make you SoA balance. Use the link Hadenough posted and pop up your SoA here and we will check it for you.

    Thanks everyone, some good advice there. I will get all the paperwork out again tomorrow morning and have another bash!! Have had a brief look at the SOA calculator thing, which looks really useful. I will do my SOA tomorrow and post it for advice. I saw they have things like haircuts and stuff on there, is that allowed? When I was talking with one of my creditors about a year ago about my finances, they said I wasn't allowed to budget in for haircuts as they weren't 'essential'. (Although yes I have still managed to have my hair cut since!!).

    Hi Fils, yes you can have haircuts, the OR doesn't want you to have to walk around looking like a hippy!

    You can't put down entertainment, sky TV, or internet, but that doesn't mean you can't have these, you just have to pay for them out of your surplus, but if it's an all-in package that's fine.

    You can put down for clothing, holidays, childrens activities (if you have any children) and school dinners. Also you can have all your insurances the best you can afford, so fully comp car insurance and accidental damage on your home insurance.

    Hi Flis :)

    Yes, you are allowed to budget for haircuts - £10 per month per adult and £5 per month per child (I think those amouts are correct - someone will correct them if I'm wrong :))

    It took me about 15 hours to do our forms, spread over several days so try not to worry too much. As has been said above, do the easy bits first and then go back to the difficult bits and tackle them one at a time :)
    You can't control everything in life....... your hair was put on your head to remind you of that :p
