qick help please

having read thru about 40 pages , I have picked up on a few things,

should I declare myself bancrupt

bank loan 3.5k
credit card 1.2k
bank overdraft £600

outstanding c/tax £120 , bailiff have been , but I refused access

gas and electric £500

tax credits £450 (overpayment)

vodafone £120

prepayment meters have been installed and are taking a weekly amount,

I have been unemployed for almost 12 mths , I am single in my late 50s , recieving £60.50 - £7.00 (overpay last yr)

i am unlikly to find work , my income is therefore £53.50 - £10 (gas / electric) = £43.50

I am struggling to live on this , and cannot afford heating , I suffer badly from arthuritus , and depression is setting in

I was recieving calls on my mobile all the time , I could not afford the bill , and have now gone on pay as you go.

I rent my property privatly , this is paid for by the local counsil , by cheque direct to him.

I have opened a coop account , as halifax (who I ove money to held on to my benifit payments)

my only assets are a car worth about £400- £500 and an old motorcycle , approx £400

my only problem would be raising the court cost to go bannkrupt

should i do this?

    welcome freddy, if you look at the first page there is a list of helpful numbers and things, in there you will find all the details of the debt charities who can help as well. The best thing to do is have a word with one of them, I chose National Debtline and they were good. Also try your local CAB.

    bank overdraft £600 - can include all of the above

    outstanding c/tax £120 , bailiff have been , but I refused access - don't let them in because once in, can't get em out! and they have right of entry whenever they like.

    gas and electric £500 - this can be included in BR but it may result in a pre payment meter being installed or your having to change supplier

    tax credits £450 (overpayment) - not sure if this can be included

    vodafone £120 - this can be included

    my only assets are a car worth about £400- £500 and an old motorcycle , approx £400 - I would sell one of these to raise the fees - it will be ok if you have no other way to raise the fees and explain this to the OR.

    my only problem would be raising the court cost to go bannkrupt - can any family or friends help you raise the money? You will likely be exempt the court fees but would still have to pay £345 for the Official Receiver.

    should i do this?

    it does sound like you are in a difficult situation and if you do decide BR is the way forward then you are in the right place to get free advice and answers to your questions.

  • thank you , did actually look at National Debtline, but got the impression , that they would help you with your creditors , to make reduced payments , i might be wrong?

    I hav,nt got any money , or the prospect of getting any to pay those outstanding bills,

    this is almost making me suicidle , my father is still alive , perhaps if he was,nt?

    national debtline will take everything into account and tell you what the best course of action for you is.... if the judge asks you in court if you have taken advice about bankruptcy, you have to be able to answer yes - if you say no, he will dismiss your petition. National debtline will recommend BR if that is the best option.

    Can't you sell the motorbike or car to raise the funds needed?

    not sure what you mean with the comment about your father :confused: but you can get through this with support so please do not think about ending things.

    donna , the halifax were horrible , and i was having to go to a cash machine at 3am , to get my benifits , before they hit me with another penilty charge , banking with the coop now

    i need my car because of my health , but am struggling to run it , the bike would not sell as its broken,

    i cane see no way of raising the £350 , needed , but i am sure i would sleep better afterwards
  • Bankruptcy is, of course, always open to you but when you take advice, ask if the service can help approach all creditors with an offer of a token payment as an alternative.

    £6000 total is on the low side to need taking the BR route (whilst i fully realise how you feel)

    get advice, asap and make a calm decision, and ask anything here.

    thank you , this does look the best option for me ,

    fortunatly most of the creditors don,t know my mobile or home No (NTL) , this is a recent No , however halifax got it?

    several companies are sending threatening letters from solisitors , threatening CCJs , as i have no capitol , how would those affect me?

    I had the same problem with halifax regarding my telephone number.....I had actually changed my number twice and it was ex directory and somehow they still managed to get hold of it! But as they asked for me by my maiden name, I just said there was no one of that name on the number....which there wasn't!

    Re the letters, that is just what they are - threats! unless you actually get official court paperwork or a letter which definitely says "we will do this" without any ifs, buts or maybes, then do not get too stressed about them. Easier said than done I know. If you do get a ccj letter, then you just have to present your income and expenditure to the court and demonstrate that you cannot pay any more than you have offered already.

    Hope this helps a little.

    if they proceed towards ccj , and they are granted , maybe x 4 , what can the court do?

    i can turn up and show my income , which from the benifits agency is - £7 per weed (therefore below min ) and can show letters from gas + elec showing direct weekly payments

    I cannot offer to pay , as I have not got the money ,

    so apart from the bayliffs turning up (me hiding my bike/car) what happens then?


    if there is no money , will it be written off? , or follow me for life ?
