    Yes, but if the claim is successful, they you sue the claimant.

    I did say that I was playing devils advocate and that I didn't think the system was necessarily right so I'm actually assuming nothing...

    Before a creditor goes through the actions of getting a CCJ (which isn't free to the creditor) a debt would usually go through failing to pay and defaulting on the debt before they will invest the time and money in obtaining a CCJ against a debtor.

    If he has no defaulted debts then does the judgement state what this CCJ is actually for?
