quick question

recently my ex left & i am now a lone parent with 3 kids

im currently receiving ctc & c/ben & £300pm c/main have meeting tommorow with j/centre tommorrow for IS claim

My house with ex is currently up for sale, now my parents have suggested that once house is sold to move in with them etc..


If i moved in with my parents does this effect any of the benefits that i receive currently for myself & kids ...

  • No. Means tested benefits such as Child Tax Credit and Income Support take into account joint income, but as you will still be single, your claim will not be affected 9that is to say, they dont need to know how much your parents earns or have in savings etc).
    However, the money received from the sale of the property will be taken into account as 'capital', and capital above £6,000 will affect Income Support. There are instances when they would disregard this capital - as an exampe when you were intending to buy anothee house with it and you were actively looking to buy one. Interest earned on it will probably affect Tax Credits. CSA payments are based on the non-resident parents income - not yours. Child benefit is a universal benefit so you will get that as long as you are classed as responsible for your children (and they are in education and under 19), regardless of your income.

    The money that i receive from the house sale will pay off mum/dads mortgage with no spare equity/money for myself & kids...
  • Be aware that there are rules surronding deprevation of capital and means tested benefits. This is when the DWP decide that you have deliberatley spent/gave away money that you had in order to obtain benefits (or in you case, to continue to be entitled to IS). If they decide that you have spent the money in order to qualify for benefits then they will treat you as still having that capital and it will affect your means tested benefits accordingly.
    Be prepared for them to ask questions about it.
    Do your parents claim Council Tax Benefit?

  • I will speak to my advisor tommorow. im not even sure if i able to get IS yet anyway, coz according to the entilted to calculater it gets reduced because of Child Maintence from Ex..

    I have no option to sell house (which is joint with Ex)..my parents plan is to part ex their property for a larger one & once mine sold money to be used to clear mortg,so I would then become joint owners with them. surely I cant be breaking any rules doing this (all i want is a secure roof over my head & the kids).
