URGENT....Deposit on New used car

We have been looking for a little run around. We have a Yaris but decided on getting an Aygo. I had been speaking to a main Toyota dealership about what deal they could get me in monthly payments for an Aygo. The agreed to bring a car from another dealership for us to test drive. I paid a £250 deposit but was told that if and I quote "wasn't happy with the car in any way we will refund it"....fair enough I thought.
In the mean time I had spoken to another dealership and they have offered us £1500 more on our car as a part ex an also less on the new car therefore the monthly repayments work our £20 cheaper a month...not to be sniffed at in this current climate.
We went to test drive the car at the origonal dealer. We returned and explained that we had had a better deal and what it was etc etc. The dealer then starts to get shirty basically accusing me of going back on a deal and then being very cagy (sp) as to whether we would get our deposit back. We were there for 45 mins going back and forth whilst they tried to get out of paying it back. In the end they have said they would but I would have to wait until today.
I just want to know whether I am within my rights to have my deposit back? In my eyes, I should as I'm not happy with the car but they seem to be saying that because there isn't anying physically wrong with the car then I am not entittled to my deposit.
I want to phone them ASAP to get it refunded to would appreciate a quick response.

in my opinion because told him you found a better deal you should loose the deposit, but you shouldnt of told him that you found this new deal.

We wanted to be able to offer them the chance to come up to the other deal, this is why we told him the situation. I hadn't actually out the deposit on to BUY the car, all I had done was had a telephone conversation and hadn't comitted to buying th car. I had also had a conversation about the fact that we were also thinking about selling our car privately to get the best price. As far as we were concerned the deposit was to get the car in from another dealer and that if we weren't happy with the car, we would get the deposit back.
I have learnt a lesson though.....never be honest!!!!0 -
I agree, you were " happy with the car " which is different to you were not happy with the deal.
You should not have paid a deposit at the first dealer IMO.;)0 -

You can understand why the dealer is not happy. They will have gone to some expense arranging for this car to be sent down from elsewhere. Personally I would never pay a deposit until I was commited to the deal.
Having said all that you have a verbal agreement so I would just create a stir at the dealership. If they still won't pay you can always try the courts but sho knows how that will turn out.0 -

I can understand that but that's the nature of business you have to take a risk. I do agree with you though Hintza I was stupid on that count and will NEVER but a deposit down until I am about to buy the car!!!0

Aye but they shifted the risk on to you.
Too many tales on here of garages doing this (promising refund of deposits), folk need to get it in writing.
I am having my own problems with verbal agreements which is going to cost me over £400 in VED on my lease car.
Discussion with lease broker:
Is VED covered for the two years of the lease?
Yes
Now a year later broker apparently my fianance provider is the only one that doesn't cover VED for the duration of the lease. Needless to say I now have to decide where I go with this having paid out for the VED for the 2nd year.0 -
Agreed, why the heck would you need to pay a deposit to test drive a car.... pay a deposit to reserve one when you have tested it and 100% want to buy it by all means....
Its like Tesco charging you £50 as you enter the shop to have a look around their store and they'll knock it off your bill at the end unless you only buy a pint of milk and then they'll refund it....0 -

It sounds like they more than agreed to test drive it, they agreed to buy it (as figures were discussed) unless there was a problem with the car.
There wasnt and thus they are not entitled to the refund.0 -
Figures were discussed yes but I was still staying that they needed to come down on the figures they had given me. All along I was saying that we were looking at other options at no point did I say that i was sold on that car. In my eyes they have totally lived up to the rep that car sales people have.....always trying to get one over on you!0
