Reclaiming bank charges in financial hardship

I contacted my bank because two years ago i complained about the bank charges and requested a refund, then the court case started and my case was put on hold.
I am no longer with the bank because they closed my account not long after i started the process.
Anyway i am now in financial hardship so i contacted my old bank after reading on this site about the financial hardship claise, but my bank told me that because i originally applies two years ago the financial hardship is not there fauly therefore i do not qualify. Can anyone please inform me if this is true or not?
