coop via / bryan carter- please review my follow up letter

posted again as separate tread, seem to have got lost..

i had instalment plan with co-op, but they got impatient and sent case to bryan carter & co.. original claim was sent to co-op in November..

(BCC tried adding on extra charges AFTER the ccj, but i told them where to go, and they have not been back to me since!)

ccj done, that paid off per instalments set by court (same as i wans paying to coop!)

co-op are now playing silly, saying they no longer deal with my (and their?) a/c..

here's my draft to Bryan Carter (i will be copying this to Co-op..)

I refer to the enclosed reply from the Co-op, in respect of my claim for refund of unfair credit card charges.

Their statement that they are no longer dealing with this account is rather puzzling, as it was the Co-op who supllied the statements that I used as a basis for my claim; They must have also requested / authorised any court action.

I do not believe the charges reflect the true cost to Co-operative Visa, and are unfair and disproportionate, so I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999.

This is supported by the Office of Fair Trading’s April 2006 statement into credit card charges, which noted that the level of charges at the time, and prior to that period, were unfair.

The charges total £180.00, plus £81.56 interest at 8% (statutory court rate).
Enclosed is a fresh copy of my claim, and a summary of charges that were applied on the statements supplied (charges covered period between Oct 2002 - July 2003; previous or subsequent charges and fees are not yet included).

Copies of the statements supplied by Co-op can be provided to you if required, upon receipt of payment of £10 per sheet. (this bit is a try-on, i admit- but they do it to us!)

Between you I am sure you can agree who should refund said charges, and I look forwawrd to receiving a cheque for the £261.56 total, within 14 days.

Please make cheques payable to xxxx. My BACS details are available upon request, should you wish to settle my claim direct.
