    Example; My OH was NOT married to the mother of his children and they were born before the change of law, yet, even though he is legally named and recognised as the father of the children he has no rights with regards to their upbringing except to pay for it, which he has no objection to doing.

    If he had been married to the mother WHEN the child(ren) were born and/or if they had been born after the said date then he would be allowed to walk into any court in the land and demand shared custody (with the childs acceptance of course), such as he was able to do with his youngest son.

    The date (1 December 2003) makes no difference whatsoever as
    1) He could make a legal application (£75) for a parental responsibility order
    2) He could have applied for either sole or joint residency (under the Childrens Act, anyone given residency automatically gets PR anyway).
