The obligation to consult over 90 days applies not just to a single location but to the legal entity, so if there are a number of wickes up and down the country then, if the law is strictly applied, you would consider the whole number of employees being made redundant. Sounds to me like they are definitely on dodgy ground if they are only consulting over 30 days!

It is not the legal entity, it is classed as redundancies made at "an establishment". In the case of Wickes, each store would be classed as an establishment, they would not be required to put the entire company redundancies together...
  • if this is the case then why are the unions telling M&S that they have to give 90 days consultation for there redundanies they are in the same possition as wickes staff was

Not seen the story so not sure exactly what "the unions are telling M&S", but they have announced 400 ish redundancies at their head office, so would assume that they are talking about that....?
  • they are making 1200 people redundant in total from different locations this is why the union is stating they must give 90 day consultation
