    just out of interest, how long did it take for you to get a CCJ? I am just starting to get default notices now and am trying to save for BR fees.

    My first default notice is less than 2 weeks old. I think in total I have three defaults. I will be BR within a month. From your experience, do you think I will have CCJs by then?

    No chance, the two I have took prob six months from default and that was with a pushy bank (nationwide).

    Another creditor I have defaulted with are still playing with threats and negotiations.

    Mind you if you're going BR next month, what does it matter if you have a CCJ before hand? Personally, I would not worry.

    I am afraid, this is the downside whilst waiting to go BR, and is the time when you start to wonder just what you have got yourself in. The calls and letters will not stop, so you have to be strong and remind yourself you are almost there. So deep breath, no body can send you to prison, the future is bright, you CAN do this. Good luck.

    i have Sky and they have just enabled caller display for me - and I can now block calls from unknown/private numbers - also i have some software on my mobile phone which blocks any calls I want it to - pretty cool:)

    Yes, thats exactly what Ive started thinking..."blimey what am I doing??" - but I do believe that it will be better when this storm is over:) Thanks for the comments:)

  • what you all have to remember is normally the threats of a ccj or they make you br is enough for you to ring up and offer your sole to pay the debt off, and their constant ringing when this first happpens every one is scared if you wait they sell the debt on to someone else and they try it , i worked it out at one point on mine they would haress for about 2 months then sell it on one creeditor i had 10 different people over a 7 year period and they never went for a cccj . my home phone rang up to 40 times aday luckely it was on silent . good luck everyone waiting to go br

    I've been norty in my past ...

    Ten years ago I had a very bad split with a partner (child involved). I ended up homeless (slept on friends sofas, in the office, where ever; for the best part of a year). Anyways, during this period I still managed to pay off debtors though I walked from a CC.

    The CC debt I walked from has been sold and re-sold over the years. I've ignored all communication. They threatened BR on me a few months ago - frightner, I ignored; the last I heard was someone suggesting a payment plan. Anyways, after 10 years and no communication from my direction, I believe it to be "statute barred" ... hey ho. I was going to include this on my SOA though felt what the hell, it's statute barred and it might raise an eye brow with the OR if I did include (questions asked .. I had a huge cocaine problem around the time)....

    Anyways, I'm now thinking of the next time a debt collector tries ringing (I don't answer unknown numbers), I might just answer, not acknowledge the debt, say who I am and give them my BR number .... and see what happens ...

    Comments, flames, etc, please ....

    I think we have all got at least one, if not more skeletons in the closet so to speak. I too had a Statute Barred debt that I left out of my forms.
    On the day of my BR I took all the letters that the DCA had sent me and sent them back recorded delivery with a copy of my BO and a telephone harrassment letter just to put a bit of garnish on it all!
    I got a good letter today - it was from Abbey, my major creditor, telling ME that I was BR.
    Good of them, eh!

    I guess it doesn't matter, just don't want anyone attaching to my wages as I really can't afford it!

    But, as it sounds that sort of action is still several months away, I will sit tight, keep ignoring the phone and hope I get overpaid this month...£495 will do! :rolleyes:

    I stopped paying my debts about a month before my bankruptcy. I wrote to most of my creditors before my bankruptcy to explain that I was having difficulty and that I had seen the CAB. It didn't make any difference and the calls started coming pretty quickly. Most are automated and on many occasions you answer but no one is there!

    For those who have to wait for your bankruptcy, hang on in there. I appreciate it's a stress when the calls start coming but believe me, once you've actually gone bankrupt, the calls are more of an inconvenience than a hassle. As soon as you tell them you are bankrupt, they'll ask for the court details and they go away. No hassle. Some continue to call (they say it's due to their systems but I suspect that it's just because they want to hear from the OR or see your name on the Insolvency Register).

    Only MBNA and Barclaycard have continued to call me despite they fact that I have notified them (on several occasions) of my bankruptcy. MBNA have also sent calling cards. All the other banks have pretty much left me alone.
