1st letter from creditor has arrived!

I have stopped payin my creditors, credit cards, this month (Jan) and have just had a letter from one of them asking me to ring them to discuss. I am over my limit on this card, should I do anything or just ignore - am goign br early march. Its put the wind up me to be honest -rather scared about it - seeing something in writing is serious to me ( if you know what I mean).

We are getting them too and are going BR around march/april. we stopped paying ours in december!!
Wish it was november we would have something to start a fire with0 -
We have been ignoring the letters/ phonecalls for 6 months prior to going bankrupt at the beginning of the month - and not one of them have carried out their 'legal action' threats :rolleyes:Number 001 of 2009! :T0

I stopped paying creditors begining of December, though I fortunately went BR last friday. My letters started over xmas (along with phone calls). I understand these to be initially computer generated letters/calls - no ones sitting there specifically employed to hound you and no one else.
I basically:- Unplugged my home landline. Never used it anyway. Why not let those you want calls from to ring your mobile rather than landline. Got an answer phone?
- Forwarded my works desk phone to my mobile - stops anyone answering it in my absence. If I got calls from my work phone to my mobile, I ignored - they'd leave a message if important - we use skype/email mostly for internal stuff.
- Ignored all unknown numbers on my mobile. I did web searches on unknown numbers and found them to be mainly Egg (most creditors seem to use 0845 numbers). I'll add that I changed my mobile number early last year due to problems with an ex (a new SIM costs about a fiver - though you'd have to let your friends know - not your creditors).
- Only answered my door when I was expecting someone. People know to call first before coming round - I've had bad experiences in the past. I live on the "not ground" floor of a building with a locked main entrance - know one would know if I was in or out. I will say I had a few unexpected callers that I ignored early Jan, though only three over a period of a couple of days. No one is allowed into your place unless you invite them (I believe).
- Letters won't get threatening till after two to three missed payments.
- They can subsequently then send a letter threatening a CCJ and you need to respond within 21(?) days.
- You can respond saying that you will contest and requesting another 21(?) days to get your "contest" together.
- After this period, your creditor will apply for a court date - however long this takes? - I bet there's a lot going on.
- The result of a CCJ is a minumum payment per month?
- You can default on the CCJ.
- If you default, the court or creditor can then apply for a Bailiff to call - does this involve another court session and if so how long for them to get it together?
- A bailiff is not allowed to enter your premises unless you've previously "invited" them in.
GIven the above CAB told me to just inform creditors of my forthcoming BR as they would have little time to throw a CCJ at me before I went BR in feb, and they probably wouldn't bother doing anything as the CCJ would be swallowed up. I chose to say nothing to creditors.
I believe the above is correct as regards CCJ and Bailiffs...
It takes some nerve, but I understand there's very little that can be done given the March/April dates you give .... just clench your teeth ....

I stopped paying mine in December well 3 of them.........
Skycard and MBNA (Aegis) have been a real pain with phone calls ringing my mobile while at work, sometimes 4 times in a day and then in the evening, Saturday mornings, all of a sudden I got very popular.......RBS so far have been good one phone call when I missed my payment explained my situation and not a single phone call since, just a default letter....
Got a bit fed up with Skycard and Ageis on friday and told them to stop ringing me......and they did, not had 1 phone call since, now I'm worried because they have gone silent......I kinda miss them ringing :rotfl:0 -
I stopped paying some of mine about a year ago!!!! :shocked:
It got to a point where they were phoning about 20 times a day between them all, even ruining my sunday am lie ins!! I think they've given up phoning me now as i never answer and not one of them has carried out any of their 'serious' threats. Ive just got a rather large bin bag full of letters to be shredded!!!
I am going bankrupt soon though, just filling in the forms, cant wait to tell them all the good news.
So dont let them get you down

Is there a not a limit on the number of calls that a single creditor can make to you in a day without it being harrasment ??? Don't know if these are calls that you answer of not though ? Someone with some more knowledge please ...0

Do what I did (not gone BR yet but have gained two ccj's prior to the decision that BR is the best option for a claen start) and write to them, telling them not to phone as you will not dicsuss the matter on the phone as they are threatening legal action you want written copies of all correspondance between you and xyz credit card.
That usually stops the phone calls. Did with mine.
So ys I have two ccj's and a charging order from one of them and they will all be swallowed from the BR.
The plaintiffs solicitor at a redeterminatin hearing a fortnight ago was really nice. Gave me a little advice after the hearing and even apologised and said he only says what he's paid to say and hoped things get better for me. The judge was even human as the original ccj was awarded for the full amount per month the cc company wanted (duh! if I could afford that I would not have defaulted anyway) and the judge said to the solicitor that that was nonsense and just numbers and didn't reflect the real world and agreed with my offer of £10 per month.
Ooops sorry to waffle on.
Also if you are keeping your lanline plugged in, have caller id and voicemail or an answerphone. Screen all calls and keep the phone volume either off or turned down low.
Many will send a letter asking you to call them to discuss the case. Just write back as I said above.
If you're going BR in March (prob when we will be too ) then this will slow them down long enough anyway.0 -
A good idea if you're worried about creditors calling is also to ask your landline provider for call barring, as most creditors won't bother (when I used to work in credit control, where there was a call barred number, it was ignored).0
