illegal bay?

Hi,

I got ticketed parking in a residential area in Hove (took my bags upstairs to my friends flat and remembered a half hour too late to get his visitors permit from him). In my despair, I put out the visitors scratch card for the next day but neglected to fill out the reg. number thereby invalidating it and picked up a 2nd ticket in the morning! I caught the PO filling out this ticket, but despite trying to explain the mistake, he said I'd just have to appeal.

I could try and appeal the 2nd ticket, but just wondered before whether the bay was invalid or not.

The residents bay has a morse-code line parallel to the curb, and where I parked, there was a double white line transverse to the curb as it was a bay end. The other side of this double white line just follows directly into another residents bay (i don't think there was a yellow line partitioning the two). I don't think the bays were individually separated, rather a long rectangle.

Is there any reason to appeal or should I just pay-up?

Thanks for any advice.

ps. the PCN tickets themselves are legal

  • !st thing all here will ask for are photo's of the bay, side on, end on and 45degrees. Piccies of the signs and piccy of both sides of the ticket. With these to hand they will be able to help you. Lots of bays, including Brightons are incorrectly painted and are invalid.

    Welcome to MSE :hello:

    When you say the PCN is legal, is this because someone has already looked at the PCN with an eagle eye, because they can be non-compliant. It need to be scanned and uploaded for someone to look at (please see the sticky welcome thread for details).

    Photos of said bay would also be useful for anyone helping out :)

    B&H PCNs are compliant at last view but they are one of the best known for non-compliant bays and even admit it themselves on occasion. he seems to have heard the 'word' somewhere?

    Pics please - and PCN just in case cos description of contravention would still be relevant even if they haven't changed and ballsed up PCNs.

  • Thanks - yes, I've been through the PCN with a fine comb using the MSE's guide and I'm confident it's legal.

    The pictures aren't great, but I can try to get some more later... I've looked at that guide before Orford and I'm wondering if my bay was something between a 1028 and 1032 as it's got double transverse white lines and also the morse code (can't be seen in these photos).

    Bang on - hybrid 1028.4 and 1032.
    The RMB link is very basic. There is a bit more to it than that - but yours is sufficiently flawed IMO. B&H know this!

    Best tactical approach IMO. In case they don't feel like holding their hands up this time then open with a plea for discretion - 'honest mistake guv and here's a cheque for a quid for parking- please let me off for one mistake' and then.

    'It also comes to my attention that --- blah blah ---- non prescribed road markings that fail to comply with the Traffic Signs General Regulations and Directions 2002.'

    In what way is the bay non compliant? The photos don't show enough of the markings.
