Asda Broken Item Will Not Help

Hello, my first post as desperate for help
We bought a Philips Handblender before christmas from Asda
my wife has used it once, the 2nd time we tried to use it nothing, ive changed the fuse and still nothing. Have been into asda and they have said it is not there policy to exchange goods without a receipt. (i know it was bought with the christmas food shopping bill so we've not got it anymore an oversight as we usually keep receipts)
Ive told them I dont want my money back just a replacement. to be told its not there problem as its not an own brand item.

Where? what? can we do next?

Thank you in advance:confused:

Although Asda should probably still replace it (someone with better knowledge should be along) you should still be able to use the standard 1 year warranty that comes with it and get Philips to replace it, but you may still need a receipt to do even that.

  • Take your bank statement if you paid by card and ask them to find the transaction.
Tell them you was not given the receipt.

Maybe contact the manufacturer and they will be able to advise or speak to consumer direct/trading standards.

Under the Sale of Goods Act 1979 the retailer in this case ASDA are legally bound to replace faulty goods. Go back and demand to speak to a manager. You are not asking for money back because you have changed your mind it is faulty and you want it replaced. If you do have proof via a bank statement that you bought it there then take that with you as evidence.

Check this link for some quick info on the Sale of Goods Act

If you have any further questions please ask and I'll try and answer. I am not a solicitor I just know my consumer rights. - it can be a bit of a minefield

... but I can see why ASDA want to see a receipt as proof that a) it was purchased at ASDA and b) it is within the 12 month guarantee period. Otherwise, from their point of view, it could have been bought anywhere and may be more than 12 months old.

Maybe ASDA's Customer Care Line might help if the store won't?
Or if there is a reference number on your bank or credit card statement, maybe their computer system may be able to bring up your actual receipt for them to reprint - after all, they are meant to be able to assess your shopping habits from saving the details of what you as an individual buy, and use the information for stock control as well.
