PC World - Sale of Goods Act

Took a PC back today, it's 6 weeks old.

PCW manager - "It only includes a 28day warranty"

Me - "Yes, but under the sale of goods act, do you accept that 6 weeks is satisfactory for a £400 pc?"

PCWM - "Sir, the SOGA only covers fitness for purpose"

Me - "Erm, no it doesn't"

PCWM - "yes it does, if we sell a pc and it will play games with a minor defect then it's fine under the SOGA"

Me - "So you are saying that a product sold for a few hundred pounds with a lifespan of 6 weeks, when the consumer expects more than a year, is fine by PCWorld and the SOGA"

PCWM - "yes thats right, now I'm not going to spend all day arguing about this! You need to phone that number to get it repaired."


Our minor defect is that the PC won't boot up at all! :confused:

    according to the manager, it's fit for purpose even though after 6 weeks the motherboard appears to be faulty.

    Just called customer services who said although the sale of goods act include durability and freedom from minor defects they insist on a repair after 28 days using an external company to repair the computer.

    The manager was of courst talking nonsense, but customer services are correct, a repair a perfectly legal course of action after 6 weeks.

    Edit: though they should still be sorting out the repair, there's no reason if it's inconvenient to you to deal with the external company directly.

    Same problem with their sister company, The Link (they are partners right?). Bought daughter a phone for xmas, now the back keeps falling off it. Seems because it is more than 14 days old(the phone was 20 days old when i called) i have to go to LG rather than The Link. Quoting the sale of goods act has done nothing whatsoever, other than cheeky emails being sent to and fro.

    I will put 10p on LG telling you to talk to the LINK.

    The contract you have is between yourself and the LINK. LG aren't really party to it. However, what they may be doing is repairing it via LG, because they contract that part of the work out.

    Your contract is with The Link. It is for them to deal wirth LG, not you.

    The ex-McDonalds burger 'chefs' they employ don't know what they are taslking about...

  • If you purchased from The Link, then you must have bought it online as there are no The Link stores around any more afaik. So surely the distance selling regulations should come into force here ??

    Please don't post half baked ideas about the legalities of consumer rights. To confuse someone with incorrect information is worse than saying nothing.
