CCJ - Ill have loads before I get a date :-(

Got a ccj this morning for my water, I already have one for a CC, am I right in thinking these cant be included in my BR, by the time I get a date all my debts might have gone to CCJ, Help............

  • CCJs are included in bankruptcy. I don't think they're marked as satisfied though, so you'll find it hard to get credit.

    However, if you don't respond to the petition or the judgement these can be turned into charging orders against your property, which cannot be included in BR if they're made final before your BR date.

    You must make sure you fill in the forms when they come from the court, you can delay things by asking to have the cases moved to a local court and requesting CCA's from C/cards. But do not ignore them.

    Sorry to hijack this thread but I have a charging order against my house which I pay £25 pound a month, does that mine that I can't include this debt in my bankruptcy?

  • Sorry for the delay in replying I've been digging out the paperwork.

    Its very confusing because first it says interim order and then month later a final order (Restons)!!
  • No, you can't include it, it's now secured against your house.

    But what if your house is then reposessed either voluntary or otherwise?

    Does the CO then 'lump' in with the rest of your shortfall?
