Reclaiming bank charges from the evil

Hi All,

I would appreciate some good advice. I have to scenarios I'd like to get sorted here quickly....

I had an overdraft with them of £150 last year and basically the day before I got paid in April my overdraft was taken away which left me £150 overdrawn. Apparently as I am from abroad, they take my overdraft facility away 6 months before its expires. Not in the terms and conditions. Anyway so I got paid and -£150 off it. I want to claim it back though do not know what to do. I complained but was met with a whole prove your residence etc. Which was no prob.So how can I make a success story. It's tough times for all me included.

Had an overdraft that I paid off eventually after endless hassles with them. £1100 was my limit but I ended paying back £1253 when they hit me with interest etc unlawfully I found out. I wrote a letter of complaint wanting £150 refunded but was met with the whole test case by banks etc. Which is bull. What avenues can I take to get it all back?

  • Have you read Martin's guide to reclaiming?

    There is always the Financial Ombudsman Service as the next step if you complain within 6 months of the final response letter from the bank.

    With RBS the overdraft agreement would have given the expiry date. Have you actually been charged for being over your overdraft limit? Those charges can be reclaimed but not the £150 that you were legitimately using. Same issue with ABbey, if there are charges then you can claim them back. Are you still residing in the UK?

    You cannot claim interest payments, neither is interest unlawful.
    Appart from a few (promotional) exceptions, any borrowing (that's what an overdraft is) attracts interest.

    I am still residing in the Uk yes. For the RBS 1 I never went over my overdraft llimit at all plus there was no expire date on the overdraft at all.

    Abbey, I went overdrawn on my overdraft as I was not using the bank account because of hassles with their banking. I kept paying funds into the account to reduce the overdraft but then they withdrew the overdraft which then left me accruing charges of being overdrawn and interest on top of that. They were not willing to accept my payment plan which was good considering many cases where people could not pay back at all.

  • With the RBS account there is nothing for you to reclaim - you have not been charged any 'penalty' charges.

    With Abbey you can submit a claim for the overdraft excess charges (NOT interest) but it will be held by the bank until the test case goes through the court process.
