Dirty Water in unused toilet?? Advice needed.

Hello
We have moved into a new build and we have an odd problem which I want to resolve but not sure where to go with it...
We do not use our ensuite tolilet very often but find every few days the toliet is full of brown/yellow dirty smelly water. I think the water/waste from out bathroom (which backs on to the ensuite) is filtering through to the ensuite loo. Also if one loo gets a slight blockage with water rising - the other does aswell. I'm sure this is not normal.
So what I want to know is why is this happening? Have the plumbers connected the 2 loos somehow or is the waste pipe from bathroom backing into the ensuite? Ultimately I want to have it fixed so I guess the builders are responsible - we only moved in in May.

To me it indicates a blockage further down the waste pipe.
I would get someone to have a look.I used to be indecisive but now I am not sure.0
