credit crunch & bank charges

Ive been claiming my bank charges back got as far as the court and my claim was stayed. Friends and I have been talking about our cases and was wondering is it likely were all get our money back when all the banks are suppose to be struggling. Will the banks argue that paying back billions of pounds will brake them? Like to hear your thoughts on this one.

    I agree with you. The way a simple man like me looks at it is the government are giving these struggling banks billions of pounds of tax payer’s money to try and help this country out of this global credit crunch. I believe our Mr Darling is thinking of giving them a few more billion.. The last thing the government wants to see is the bank getting back into financial trouble by paying out billions of pounds in bank charges. This I believe will be a factor the government will place on the three appeal judges before they make their decision.

    The OFT test case is based on the Law and not on any other factors. If the banks lose the OFT test case they will have to pay back the bank charges. The consequences are irrelevant to the Law.

    That is something that the Government cannot do which is to interfer in a legal process.

    If the charges were before your bankruptcy, they’re not your money anymore.

    The OR could reclaim them to distribute among your creditors (pretty unlikely scenario).
  • well thats given me a bit more hope, cant wait til it is all over and we all find out.
