NatWest bank charges info...?

I first sent of a reply to the NatWest branch In Birmingham, who deal with charges, back in August of 2007. My total request came to the region of £2,500. I used these templates on the site and had my statements which I paid £10 for, where I was able to calculate the charges.

I am currently in 2 processes with Natwest; 1) where I am reclaiming back my charges and have not heard from them since July last year. And 2) I am repaying my overdraft as a result of these charges.

I was first in arrears of £247 (repaying the overdraft), and I have the receipts to prove that I paid, I think, was around £300 back, and yet I still owe NatWest money and my account is in default action with Triton Credit Services where I am forced to repay yet another £350!!!

Below is my letter which I mailed to them;

[FONT=&quot] I am writing in response to your letter informing me of the Default action taken on my Account ******** on 23 July 2008. I would first like to state that I had been on several repayment schemes, and unfortunately, there has been instances when I have been unable to make a payment, thus resulting in the cancellation of my repayment scheme. As far as I am aware, I had 3 payment plans and I was always paying as per the contract in full. [/FONT]

[FONT=&quot]I am now annoyed to receive a letter claiming that action is to be taken against me due the non payment of overdraft. I am sorry to say, but it angers me that I have been paying back the money owed, which as far as I can remember, started at £56 pcm on the first repayment plan, £51 on the 2nd and £45 on the previous plan. It further annoys me that although I was informed and assured that no charges would added to my account except for Interest, which was never more than £3 pcm, this wasn't the issue. The main issue, which is why repayment has been near impossible for me, is that even though I was repaying £45 every month into my Account, I would incur up to £30 in charges and in some cases, as much as £60.[/FONT]

[FONT=&quot]It is these charges that I was assured not to be effective to me that are the reason why I am currently in this position. So I urge you to take note of this letter very carefully as I feel very strongly that the opposed action is not only unjust, but also unlawful since NatWest went against their word regarding the charges on my account. If necessary, I am happy to make photocopies of my statements where I was repaying the £45 pcm into the Account, yet ridiculous charges were still being made.[/FONT]


Now you can see my anger as I not only repaid the arrears (I did have photographic proof until my pc broke but I have the receipts still). But for every £45 I was paying to clear the debt, £30 was being deducted to cover charges, so I was effectively only repaying £15 pcm.

That, on top of my unlawful charges which I am still waiting to receive, are very annoying and really make me wonder why I'm even bothering to pay.

In regards to my charges reclaim, how do I call NatWest direct to see how it is getting on? I have unfortunately lost all my copies of the letters I sent at the time so I can only hope that with my details, they can find my case and give me some information.

    When you first set up a payment plan to repay the overdraft had the account been defaulted and sent to collections, and was the repayment plan with them? do remember the terms of the repayment plan at all ?

    Have you still been using the account, or simply had it sitting there trying to pay it off ?

    If you aren't claiming hardship from Natwest then your claim will still be on hold re the test case, however passing the overdraft to Triton for collection after you have placed the account in dispute, and especially since you are making payments to repay the account is against the waiver guidelines set by the FSA and by the OFT debt collection guidelines, so I would mention that in your next letter too.

    Oh also, I would write to Triton and tell them the account was in dispute before it was passed to them and they should kick it back over to Natwest

  • When I failed to meet the payment date because it wouldn't always be on a day when I had money, they offered me another repayment plan and I am so financially ungifted that I just couldn't remember when the money was due, and I would never receive a letter reminding me that a payment was ready to be collected.

    In answer to your question, I was told by NatWest that my account had been defaulted, so therefore, I couldn't use it if I wanted to, and I didn't dare to anyway, so yes, it was just sitting there being paid off. But I was constantly incurring charges for being overdrawn, despite NatWest assuring me that no charges will affect my account, yet they still did.

    Currently, as far as I am aware, I have a Standing Order from my current bank to my old NatWest account @ £10 a month to pay off the £350 debt, which I have complained about since I found it unfair that I was repaying the amount as asked, yet the charges incurred were making it harder to do so.

    Okay, you need to get as much down in writing in a letter as possible. Dates as far as you can remember, and we can add in the FSA waiver etc parts in and give them a boot up the bum. When you made these arrangements, I know you have lost letters, did Natwest put them in writing? or just on phone?

    Hows your credit rating? if its shot anyway I would stop paying them.

    We'll get a strong letter together if you can pm me with the details you recall, also updating your claim for charges to include the ones to date and ask to put a complete hold on the account. However probably wise to wait for a response to the letter you sent above first - 7 days should do.

    What are triton threatening?

    Ummm I don't get over here all that often, so if I don't reply give natweststaffmember a bump and he'll come grab me.

  • I'll have to look through all my files but I'm sure something is there. Triton aren't threatening, but I hate owing for something I've technically already paid back.

    sounds like when you missed a payment the agreement was then void hence the charges starting again on the account. Normally from what I can tell when you have an agreement your agreed o/d limit is set to the amount owed each month so you don't receive charges but if you default on the agreement then the o/d is set at 0 and you incur charges as if teh account was just overdrawn.

    Aye sounds likely, the main issue is the passing to triton while under dispute really. The arrangement and charges will be secondary to that.

    Hopefully we'll get the account put on hold passed back to natwest and kept on hold freezing interest and charges pending outcome of testcase then a refund of the charges, thus clearing the account in full including overdraft interest to date.

    WOW!! i have to say out of all the threads of read on here.. You seem like the oracle of them all...! My other half has huge problems with NAtwest also.. Not in regards to a overdraft though.. Just charges for having an account with them.. he never activated his card, never used his account, even asked them to stop charging him the monthly fee for having an account and now they want £300 ontop of £310 we already paid to shut them up?? what do you think with that one.. SORRY OP to steal your limelight just its 2:30am and not sure how much longer i can stay awake....

    Sorry for further thread hijack, but have you converted the Advantage Gold account back to a current plus account to avoid the monthly fees element of it?

    it was advantage gold and they clsed the account now and have morcroft chasing outstanding monies... Notified obundsman..
