Car Insurance third party claim

Hi,
The car was involved in a minor accident the other day and needs a new wing and driver's door. The other driver (company car so wasn't interested in doing a deal) was at fault (pulled out of a junction without looking) so looking to claim on his company insurance. However, my car is only insured third party fire and theft and is worth significantly less (£1000 max) than the amount to repair (£1500+ (new wing and door and paint job)). As the car is still in relatively good nick and should still pass its MOT I don't really want to get rid of it. Therefore if I claim on his insurance can they just give me the market value or can I insist they repair it? My feeling at the moment is just to do the work myself as I can get a door & wing from the scrap yard although could do without the hassle. Also do I need to go through my car insurance company or can I just go directly to his?

    depends on the market value of the car as insurance repairs only use genuine parts, its chance to be a write off mate, however the insurance will pay you market value less scrap value if you want to keep the car and repair yourself,
    let your insurance company know about the accident and personally go to a non fault accident maagement company like helphire, or driveassist

    Insurance companies don't just use genuine parts, although a lot of customers prefer them to use genuine parts, though even Veng parts would probably total loss your vehicle from the sounds of it.

    You can ask for a cash-in-lieu payment up to the value of your vehicle, and you can have the car repaired however you want

    If the engineer does total loss your car, it will be registered on the MIAFTR database and DVLA will be advised, but you can still take the pre-accident value less a small deduction for salvage, keep the vehicle & repair it however you want, as long as the salvage category is C or D, then get a VIC done, and bobs your uncle back on the road in your own car.

    Cat D's dont need a VIC done on it.

    However some insurance companies insist on the car being re-mot'ed after it has been repaired, so just check on that.
  • hi i need some help and advice. i've been involved in a minor accident on friday evening (3 cars involved and the first driver stopped suddenly and drive off straight after) but me and the middle driver bumped into each other. the middle driver called today saying he is going to claim and i don't know what is the standard procedure cuz i never been involved in an accident before. the insurance company implied that it would be my fault because i was the last driver, although the first car is responsable for the accident. is the claim of the middle driver going to affect my insurance?

    If you drove into the back of him, then it is highly likely you will be held liable for the costs associated with the damage you caused.

    Your insurers will sort this out. Inform them now about the accident and make a claim if you want them to pay for your own repairs. Just pass on any correspondence you get from the other driver to your insurers.

    If they agree to pay for the repairs to your car, then you will have to pay any excess agreed on your policy, but no excess is payable for any costs they pay out to the third party.

    If a claim is registered against you as being your fault, then you will lose 2 years ncb when you come to renew. (Unless you have protected ncb).
  • There are exceptions to the liability 'rules' (lets call them) which is why i'd be interested to know where this 'incident' might of happened, to gauge a feeling for it.
