Points for speeding or voluntary ban?

A few months ago a client told us he had been advised by his solicitor that there is a little known law that allows drivers caught speeding, to elect to accept a voluntary ban and not have points applied to his licence. The fine stays as is.

Does anyone know of such a law?

    Utter rubbish. 99% of solicitors are useless on motoring law, and I seriously doubt that a specialist motoring solicitor would give such flawed advice.

    What would be the point anyway, if you have 9 or more points on your licence, another three will get you a ban anyway under the totting up rule, and if you've got less than 9 you can keep driving with another 3 added, so why would you want a voluntary ban?

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    No, and what would the advantage be? You would have to declare that you were banned to your insurance company, even though it was voluntary, and do so at renewal for the next few years. That will hammer the living hell out of insurance premiums where 3 points for speeding is likely to make little difference, even on your second offence. It is also likely to exclude you from jobs where driving as part of your job is involved.

  • If it is the first time being caught on camera for speeding, the only alternative would be attending a speeding course (approx £72), and no points would be applied. This is a one off for first time offenders.
