financial difficuties re.bank charges.

Have been following success stories but i have failure one.I applied for bank charges in August but they refused to look at them due to awaiting court etc.I went back to them as i have financial difficulty due to disability so they called me in for a face to face interview,that was 2nd december.They then sent letter telling me no decision will be reached until 2nd january.They then sent me a letter saying no decision will be reached until 2nd february.Have i lost the case?
