Hi,
Around the beginning of Jan I ordered a Xbox 360 from Argos. Before it was dispatched, I emailed to cancel as I had picked one up from my local Game Store. They emailed me back and confirmed that the order had been cancelled.
Today I get a call to say that they want to charge me for the console as apparently it was delievered. I told them that it had not been delivered, to which they said they had a signature and therefore, it was delivered.
I said I would look into it, and have asked all of my family if they had signed for it and put it away somewhere, then forgot to tell me about it. To which no-one had!
What are my legal rights on this, I havent recieved the product, they took the money from my card and then refunded it, and sent me an order cancellation email!
Any ideas guys?

Ask for a copy of the signiture, which will show it isn't you or a family member. Here I go again on my own....0

Either get a copy from them of the signature or send in a copy of your signature to them to compare. I work for the courier company they use, they will be able to find out the date and time it was delivered, the time it was recieved by the delivery depot and who by and the time and person who had it on their van. You could also ask them for the UPI / tracking number of the parcel and check the tracking at HDNL**BERTIE**Did you Know: It costs more than £325,000 a day to run the lifeboat service? (with no government funding) Please donate to the RNLI0

Thanks guys, I will check into it!0

Well surely they wont be able to charge you as your order was cancelled - I would of also thought that you will be able to instruct your card/bank not to allow them to take any money.
They will be proved wrong when they look at the signature anyway, good luck and keep us updated!Weight Loss - 102lb0 -
Well, its their own mistake anyway because i cancelled the order, and had a refund for the money! Its their own fault if the still sent the unit out!
I phoned Argos and told them that I would like to see the signature that was used to sign for it. Someone is getting back to me apparently within 48hours!
Will keep you all updated! :j0 -
