IPOQ help needed

Hi it is almost a year since i contacted this forum and i have 6 weeks to go till the end om my BC. It was thanks to everyone on the site that i got through this year especially at the beginning.
I recently received a IPOQ form to fill out which i did stating my income
Income £679.60 made up of
wages £520
housing £159.60

outgoings £678.00 made up of
Rent £300.00
Heating etc £30.00
Telephone £ 10.00
food cleaning £265.00
essential travel £52.00
Clothing £ 21.00

leaving £1.60

I received a letter today saying they want to take £52.60 for 36 months starting from January the 30th.

How the hell can i pay that when I barely have enough to look after myself:confused:
This now means any plans to restart my life from scratch will have to be dropped ,as anything I earn over that amount will be taken away for the next 3 years. There really seems no point in living with this over my head!!!!!!!

I'm a single man of 52 for gods sake give me a break
There's some guy down the road from me who has gone bankrupt 3 times and doesn't pay a penny why me!!!!!!!!!!!!!!!!!
does anyone know the rules on this PLEASE help

  • This seems really cruel especially as you've only got 6 weeks to go. Speak to your OR and ask for an explanation because they may have made a mistake.

    Hi qsip, you need to contact them and ask for a breakdown of exactly how they have found a surplus of £105.20, they must have cut soemthing back to get that figure, but as you've so little it's highly unfair, and there are alot of things you can and to your I&E to get your surplus below £99.

    But don't panic, remember, this in an IPAgreement, if you do not think it is correct you have the right to challenge them, and if they insist they are right you can go to court and they will have to prove that they are being reasonable, which quite clearly they are not. I honestly don't think it would come to that though, they only have 6 weeks left to get an IPA in place, so string things out as much as you possibly can. I really can't see them wanting to stand up in court trying to prove this is fair.

    thanks i think so too, they young guy dealing with the case was a bit of a jobs worth!

    i cant see what they want to achieve i need new glasses and i dont have the momney to pay them aslo if i had excess money the housing would be the first to clainm that back ........................i was so sad to day i had it all planned out for a new start....................hey but i will win even if i make myself home less and camp on there doorstep!

    If he comes back and says he's taken something off your housekeeping for example, have a look at all the other areas you can claim that you are not, you can put at least:
    £10 per month for opticians and another
    £10 for dental,
    £ 5 for prescriptions,
    £30 for clothes,
    £10 for contents insurance.

    That should get rid of of half his supposed surplus. If he wants to play silly games, so can you!

    Just an observation:

    I've totalled up your outgoings(£300 + £30 + £10 + £265 + £21, and it doesn't come to £678 but they come to £626. This figure bizarrely enough is exactly £52.60 below your income (all but a pound!).

    What I reckon therefore has happened is that they got your disposable income noted as £52.60, and quite literally have put it in the wrong box on their form.

    With that figure, you should of course pay zero. Go back to them armed with the above and tell them that it appears they have made an admin error.

    Yes, keep smiling - I can't see any conceivable way that is correct. I can't see that they would cut anything back either as it is in no way excessive.

    If they insist they are right for whatever reason, you also always have the right to ask to see their calculations - they would probably send you a copy of that spreadsheet duly completed.
