HSBC charges back in May 07, what about after trial case?

Hyperthetical I guess but..
I never realised how much I had been chaged by HSBC. I only did my husbands and we got the money for that back in May 07. Looking at mine got me thinking. Dh got £1122 of the £1338 he was charged. So were this test case to go in our favour and all charges were refundable, could I claim back the remaining?
Or in taking the money, it was in full and final?

My understanding is that if the court case goes against the bank then I would say that you would have a case for the remaining charges.Hyperthetical I guess but..
