    There are exceptions but most bailiffs ly throught theri teeth.

    I have received your e-mail and will respond but I am copying the answere here as well becuase other people may well benefit from the advice.


    If yoy are unable to keep to keep to the payment arrangement you can apply to vary the payments by filing an N245. If you are on benefits you will need to also complete an EX160 form do that you do not have to pay any court fees.

    In our experience all County Court bailiffs are very reasonable to deal with as they are civil servants and do not receive any commission.

    It will take a while for the application to go through and for this reason all that you need to do is to telephone the bailiff office at the County Court and explain to them that you are completing an N245 to vary the order. This should be fine. You can download the form from HM Courts Service website and complete it on-line and then print if off.

    How much are you paying at the moment and how much is the debt?

    i understand that but do i have to fill in the form to suspend the warrant the amount im paying is fine and i want to continue paying this .The payments are all upto date now so do i need to suspend the warrant this is the bit im confused on

    Yes, because as you said in your first post you 'just want to carry on paying by instalments without the bailiffs calling'

    If you're saying the instalments are affordable then why did you default on the order in December? I think you should take this opportunity to review your income and expenditure and maybe get the court to shave a bit off the instalments.

    Thanks for all your help ,oh by the way i defaulted on decembers payment as at the time I was at a top london hospital with my son who has a liver disorder it was not intentional and was paid as soon as i recieved the letter ,my son took top priority,also i cannot shave anything else off my outgoings i have got rid of anything that is not needed except the internet which i dont pay my sister does for the kids for their school work mainly

    I would strongly suggest contacting the creditor to explain what has happened and to explain also the situation concerning the ill health of your son.

    Hi I contacted the solicitors of lloydstsb(who i had the cc with ) and explained and all they could say was to contact the bailiff and i had to deal with them now as the warrant had been granted .I spoke to a bailiff but not the one who is dealing as he wasnt there and he seemed pretty ok ( as bailiffs go) and said to fill in the form as soon as i got it and also to speak to mr gray (bailiff dealing)when he was back in the office on tuesday and he would prob wait for the form to be dealt with and see what the outcome was with that .So this is what i'm going to do and hope for a good outcome but i know i deff wont be opening the door or window to them if they do come out on wednesday

    was told when i spoke to the bailiffs that i had to speak to the bailiff dealing but he wasnt there and wouldnt be until tues (today)when he would be in the office bailiffs office open for calls from 8.30am tried and hes not there obviously i will keep trying but what should i do if i cant get hold of him as hes due out tomorrow

    meant to update yesterday finally got to speak with the bailiff and he was actually kinda nice to speak to still wouldnt let him in my house though!! Anyway he told me to fill the form in as suggested and send it off but didnt say whether he would still be calling to my house!! so so far today i've had quite a stressful day waiting and seeing if he will indead call or not
