Job lose over a false Reference ?

  • First of all, i'm sorry your daughter has been put through this ordeal. i'm frequently annoyed by the number of employers who expect people to work like machines with no sense of weakness whatsoever. there have been too many complaints on here recently about employers complaining of genuine illness.

    Secondly, she CAN get through this. If she keeps her head down, there is no reason why she couldn't get a good reference from this new employer. As far as i am aware, a former employer can't give a bad reference in the sense that it's a personal attack, but it's difficult to prove this.

    My cousin left shop work (mainly because of her manager who didn't sound very nice) to work at alliance and leicester. She was doing very well, until a reference came through that said she was "dishonest" "difficult to work with" "disliked by some", "confrontational" and a "trouble maker". All of this was completely unfounded of course, yet her employers perceived this as "fact" that her former employer was making a judgement based on his experiences with her. She had her offer of work withdrawn. She applied for another job and her employer actually, upon receiving this reference told my cousin he must have been a very nasty man to write something so vindictive. she's been happy at work ever since and this is just a slur.

    I was called "dishonest" in a reference once, because i applied for another job and confessed to my line manager that i was worried about saying i was looking. My line manager told me not to worry to take the day off and she would tell my manager and try and put it in a good way. the day before the interview, i checked with my manager that she knew and "it was ok right?" My manager laid into me calling me underhand for not coming to announce it to her honestly and upfront. i was only 19 years old and when i got offered the job, i found out i had this reference, and they extended my probation based on "concerns about my good character based on a reference". The point is she can come through this, but i feel sorry for her because its dreadful to have a slur on your character without right to reply. x

    Just got back from getting legal Advice and my Daughters Reference is a
    Derogatory Reference
    and now this advice is being acted on now and we are seeing where she stands as
    regards employment law too.

    why do people/companys write such things and leave them selves open to such action

    surely companys/care facilities etc are crying out for good honest trustworty care workers

    She can reply, in fact claims for negligence of this type can result in substantial damages. You and your sister if given unfair references could of taken your old employer to court.
