Ebay item return who pays postage?

Hi,
I have to return a hoover to an ebay shop for the second time for repair. I have a couple of questions please if anyone can help me.
1. Can I ask for a refund as this is the second time I've returned and I'm not happy with the quality. :confused:
2. If I return for the repair, can I insist that they pay postage? Or is it my responsibility? It will be about £10. I don't ahve original packaging either btw. :confused:

    You have to pay for the cost of returning the item to a seller, but I think the rules are different of they are a business, but then they can cover themselves if they have stated that buyers cover return postage in their T&C

    If they are a business seller their T&Cs are not allowed to contradict consumer law, which I think states that the onus is on the seller to arrange or pay for collection of the faulty item.

    Bit of a grey area here. If the goods are faulty when you receive them or within a very short time (14 days or so) the seller should pay the return costs. If they delivered it by courier they should be able to arrange a third party collection from your house. If this is the second time in a short period the good have gone wrong I would be tempted to reject them as not being of merchantable quality.

    No you don't! If its the sellers fault you are returning the item, eg faulty, item not as described then the seller should pay for return, in law they should have the item collected.

    It isn't always straightforward getting the return postage paid and sometimes you may need to cut your losses and pay it yourself, but that's an individual decision.

    For Jaycat62, it depends on whether the item was sold as new and perfect or not. If reconditioned your position is weaker.

    They are reconditioned hoovers from hoover, electrolux, the first time was within a week, now it's 5 months. Thanks so much for your replies btw, I'll check their t&c's as they are an online shop.

    This is from their site:
    The vacuum that you purchase is covered by a 12 months return to base guarantee which means if during the first 12 months of purchase the vacuum develops a fault we will repair it and return it to you free of charge. To claim on your guarantee all you need to do is contact us via email or phone with the problem.
    Upon receipt of purchase if you are unhappy for any reason we simply ask you to return the vacuum and we will refundyour money.
    Does this mean I can ask for a refund now?
    They do not appear to make it clear about returns. I emailed them and they just said return it, when I questioned postage I have not heard from them.
