in Credit cards
My husband applied for a Virgin Money Credit Card in November.
He received the PIN number on 16 December.
Credir Card said it would be despatched 7-10 days.
Rang up today as we hadn't had it, £5000 has been spent on the card!!
Apparently the PIN was accessed over the internet!!
Help......where do we stand?

I'm pretty sure you need a copy of the statements over the last few weeks.
I dont know. I should really find out. But yeah, statements, as if any payments are made over the net there should be reference numbers with legit companies?0 -

Someone may have stole the card during the Christmas mail.

You said you rang up today and found out that money has been spent on the card. What did Virgin say? Have they said your liable or are they investigating?
If it is a fraudlent transaction I cannot see you being liable for it especially since it was a new card which you did not receive and you did not activate. When you get new card either a debit card or credit card there is usually a number to ring to activate the card so it is a question you can ask the credit card company whether the card got activated by them. If so i'm sure they will have it recorded as most calls are recorded - this should prove it wasn't you who activated it.0 -
The card has definitely been stolen, intercepted on its way to us.darkcloudi wrote: »Someone may have stole the card during the Christmas mail.

The transactions were definitley not mad by us.
They are investigating now.
They won't tell us if/how the card was activated!0 -
Best of luck.
Re missuse or theft of your PIN. The Banking Code advises you to keep your PC Secure.
Article 12.11 States roughly that if you act without reasonable care, and this causes losses, you may be responsible for them. (What is reasonable care?)
Article 12.12 States roughly that unless your card issuer can show that you acted fraudulently or without reasonable care, you liability for the misuse of your card will be £50.
The good news for you is the last sentence in Article 12.12
If your card is used before you have received it, you will not have to pay anything.
TIP: When getting your next credit card, get yourself a Chip & SIGNATURE Card which equals - No liability worries.
Good luck.0 -

We hadn't even opened the PIN.
They also said that there was a query on the account on 26/12/08 due to the high level of spending but nobody contacted us!!0 -
If you never received the card, then you should have zero liability - it is not down to your negligence, but banks being too tight to use a secure delivery service.0
