    Well the standard CCA letter as mentioned above by Mrs Tine is going into the post at lunchtime (soon as I can get a £1 postal order from the post office). Will keep you updated on what comes back, and thanks for all your replies guys.

    I/we understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act.

    No, it's the initial CCA letter (the second one you have quoted) that I meant

    Sorry, I found a thread where Mrs Tine had posted that one, and that's what I was referring to. (i know she pasted in the other one later)

    Hi GP - Long time since we saw you on DFW :rolleyes: - welcome home :beer: .

    Not a lot to add to the advice already given. If you do not wish to go through the cca route, initially, then you can always send the 'prove it' letter that blue is the colour has posted.

    To me it looks as though this is a standard 'phishing' excercise by Advantis - maybe they are chasing a very old debt, or purely attempting to 'bounty hunt' against a default that has not been removed from your crf.

    In any case the onus would legally be upon Advantis to prove any debt that they are 'chasing' - so:
    • Do not phone them.
    • Do not provide them with your signature
    • Do not worry.

    I got a response back from them this morning saying they could not disclose any details with me due to DPA, but could I call them to confirm the dates I had lived at 9 *** Road, Manchester M14 ***.

    I've never lived there - it's at the opposite end of manchester.

    So despite the advice, I called them - sorry, this had been on my mind all week.

    Seems that because the person shares the same initial as me, and the same surname, and lives in the same ****ing city they assumed it could be me. All that stress and worry on the thinnest of 'clues'.

    Livid now. Been stressing myself stupid. Hate to think what could have happened if I'd been some little old lady.

    Thanks guys, for all the help and 'dont worry' reassurances.

    Typical DCA tactics, write to anyone who vaguely sounds like the right person and hope someone pays up, it's disgusting.
    Unless I say otherwise 'you' means the general you not you specifically.
