arghhh mud caused accident...council to blame?

  • no the verge is destroyed and the mud is dragged by nextdoors tyres all over pavements ...he id driving over pavements meant for people to walk on, the road is worse by the way ...

  • wel to get to mine actually , unfortunetly, he doesnt keep his mud to just himself.. he shares it ... still photos of what it looked like today are bound to land him with a fine atleast.

  • drive illegal due to not permiable and no planning sought... se new rules, not to mention no dropped kirb or suitable surface to drive on.

    Everyone on here was very quick to say "there is no claim"... yet, the OP did (as well as others) report the problem to the council beforehand, and they chose not to act.

    I know that if you report a pothole or other road defect to the council, they are obliged to repair it or pay for any damages caused by it until they repair it... so is it really that different in this case?

    We know that the council CAN act in this situation - by taking action against the "illegal driveway" holder and putting an end to the muddy road. So the fact that they failed to do so demonstrates negligence.

  • well highways council bloke took them so unless he's about on mse , i guess no. i will pop in to council offices next week and see what has happened but they might not tell me.
