Everyone on here was very quick to say "there is no claim"... yet, the OP did (as well as others) report the problem to the council beforehand, and they chose not to act.
I know that if you report a pothole or other road defect to the council, they are obliged to repair it or pay for any damages caused by it until they repair it... so is it really that different in this case?
