Potential Subsidence - Help please!

Hi,
I am new to this site and in need of some help/advice as to where I stand..
My partner and I purchased a property in August 2008, we didn't have a structural survey but did have a valuation survey which didn't highlight anything. at the time our mortgage advisor told us not to bother with the structural unless anything came back noted on the valuation.
We moved into the property in October and everything has been fine.
There is a stand alone garage at the back of the property which borders a piece of green land that is owned by our council. we had noticed that 2 parts of brickwork on the garage where a different colour to the rest and that the garage had evidence of damp.
This morning a roofer came out to give me an idea of cost for the flat roof on the garage to be re-done. However he pointed out that we had bigger issues in that the garage was actually sinking on one side. Something that myself nor my partner had ever noticed.
The green land next to our property does get water logged and drains towards our garage which is what we are assuming is causing the problem. However there is also a man hole right by the garage; everything by this manhole has sunk. paving slabs etc are all sinking and/or crooked.
I phoned our council and they sent someone out who said there is definitely subsidence and that the garage would probably have to come down and that off the record "we'd have fun and games trying to sort this with the council".
He was a nice guy and has passed me over to the relevant department who I now have to write in to.
Now obviously there is no way to determine the cause yet, but my main concern is will we be covered on our insurance.
We are with esure and I know we are covered for subsidence but as we dont know whether this was there prior to us purchasing I am worrying that they may throw the claim out.
Any advice would be appreciated.

The conveyance should have picked up any previous subsidence.
So if it didn't this will probably be new.0
