I parked in a private shopping centre car park. It was dark and having driven round twice could not find a marked bay, so parked in an area where there were no lines. On returning 10 minutes later I had a ticket from CP Plus Ltd BPA approved saying I had not parked in designated parking space. There are signs up saying you must park in a designated parking space but this was my first visit and it was dark. The PCN is hand written and says my car is black (it is dark grey) and also the date looks like 10/01/08 (but could be 09). Do you think I have a chance of getting off of this fine? Any info would be appreciated.
Thanks
Thanks

Please start your own thread so it will be easier for someone to help you. Also read the stickies at the start of this section of the forum regarding PPC tickets. This is NOT a fine just an unenforceable invoice.:DI'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
Thanks for replying not too good at this but thought had started own thread.0

This is not a fine, it is an invoice from a private company. (BPA is a trade association - it has no powers)Do you think I have a chance of getting off of this fine? Any info would be appreciated.
Read Martin's article on the main site, it will confirm that if you don't communicate with CP Plus, they have a 0.00001% chance of enforcing this, and will most likely give up after a few threatening letters.
Do not contact them, do not pay them, it is a scam.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
can any one help!! I work in a hopsital as a nurse the car park in managed by cp plus, staff have to pay an annual amount to park in staff car park, This car park is often full, I parked "illegally" in a drop of point with every intention of moving it later when a space became available, I was given a fine, I have not paid it, others park there and do not get tickets, I think they are going to take me to court! oh dear.
CP plus say that the amount I pay annually does not guarantee me a space and I should pay in the visitors car park if there are no spaces available. so therefore paying twice!!
any Ideas on what I should do?

It isn't a fine, it's just an unenforceable invoice. CP Plus don't do court, although they will send out threatening letters to try and scare you into paying up. Best advice is don't contact them in any way, and ignore all their bullcrap letters until and unless the extremely unlikely court claim form comes from a county court. The defence is a simple one: you already paid to park, therefore their losses =£0.00, which is the amount they can claim.
As this is a work related issue, I would suggest talking to your Union rep, the Union should be lambasting the management for allowing this sort of nonsense to occur.
