    go to Shelter with your tenancy agreement - they will give you precise advice on this rather complex tenancy

    Yes the S21 should be signed but there are lots of technicalities that the landlord should fulfill when serving one. Just because it is signed, doesn't make it right.

    It is complex your situation, I am trying to help you get your papers in orders and get all the right info together so then you can go armed somewhere with all you need who can view it all and give you the full advice. It's very difficult to advise on such things fully without seeing the documents but you are now on the right track.

    Any s.21 notice can be served by the landlord our their agent without going to court.

    I am just trying to understand the landlord/owner comment you made a couple of posts back. Your daughters landlord doesnt happen to live in the property with her does he? If thats the case it would be a completley different kettle of fish.

    Maybe it would be useful if we clarified some terms here so that we can avoid talking at cross-purposes.

    Tenant = The person who is named on the tenancy agreement. Other people can live there too (i.e. children) but they are not the tenant.

    Landlord = the person who actually owns the house/flat. They can rent directly to the tenant or can use an agent to act on their behalf. They are not obliged to use an agent so if they do not then everything written below under 'Agent' would apply instead to 'Landlord'.

    Agent or Letting Agent = a person or company who acts on the landlord's behalf in finding tenants, collecting rent and carrying out repairs to a house/flat. They will also be responsible for serving notices to end a tenancy.

  • just to let you know her landlord as come to her address and said he is giving her 8 weeks notice in a letter and she will recieve it shortly,when she dose can you give me any advice about this please thank you in advance
  • plus he said he is putting a notice on her window to say this premises is for rent can he do that before she gets evicted??

    What the eight weeks notice means is that if your daughter does not move out on or before the final date given in the notice the LL may then apply to the County Court for a Possession Order. She should take the Notice to a CAB or a law centre and ask for someone with specific LL&T experience to look at it. She can also ring the local Council and ask to speak to someone on the Private Sector Rentals Team. (they only deal with private LLs, not Council housing issues)

    It will probably be the case that for your daughter to get help with rehousing she will have to wait until after a Court Order has been issued. If she leaves before then or she has rent arrears then the Council may say that she has made herself homeless.

    Yes, the LL can advertise the property but your daughter does not have to consent to anyone viewing the property.

    She may find it useful to talk to someone at Shelter 0808 800 444 (8-8, 7 days per week)

    You said he's giving her notice because she has two kids, but presumably she's always had them.

    Is he giving her notice because they're terrorising neighbours? Or wrecking his house?
