Unrecognised Transactions

In Aug 2006 £9200 of transactions appearsed on my credit card.
After much correspondence with the Bank in question they decided to hold me responsible with the transactions.

I have been told by my solicitor in recent days that they believe that my chances of success in a court would be in the region of 10|20% maximum, therefore I should agree to this settlement, prior to this they have said the I would have a 50|50 chance of success.

I have been dealing with a solicitor since September this year inorder to resolve this matter with the bank, my solicitor wants we to agree a settlement which involves, me paying over half of the £9200 in total plus a large portion of their fees also.

Does anyone have any views or direction on this matter!?!?

Kind regards,

Glen Marquis.

It appears the bank, as well as your solicitor hold you responsible.

You're not very forthcoming with your side of the story. Without any details, nobody here will have any views.
For all we know, the bank and your solicitor might well be right!
  • Hi, this sounds really bad! Maybe you could describe a bit more about these transactions and why they hold you responsible?

Were these transactions made because of a lost/stolen card?
    A second cardholder?
    On the internet?
    Made with your knowledge?

I'm guessing they must have a reason for holding you responsible so a bit more background info would be helpful?
    Good luck, Matt.
  • My guess is you either:
    1) Had a 2nd cardholder who spent loads of money without you wanting them 2.
    2) had your wallet stolen and you had your PIN on a peice of paper in the wallet and you told the bank this.

If it was standard fraud, it is up to the card issuer to prove that you were negligent with your pin or anything else to do with the card.
    As for the 2 options:
    1) you put the person on your card in the first place - any debt put on by either of you is yours and yours alone.
    2) as soon as you admit its on a peice of paper in your walet, you are negligent and bank is not liable.
  • Can I ask you all what is considered being negligent with your card/ pin number? Or what does the bank have to prove to be able to make such a claim?
  • One of the standard questions asked is how do you keep your PIN - anything written down is considered very risky even if used in code.

....Customers who are not appropriately wary due to intoxication or such, making them vulnerable to pickpockets is one of them - apparently! ;)

With the introduction of Chip & Pin the liability really did shift from the bank / card issuer to the retailers & customers.
These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!
