i am so mad is there anything i can do

Hi all please help me i am getting so frustrated

we had a accident on the 23rd april 2007 we were fully comp so our car was repaired free of charge. my partner was then paid out for the personal injury he recieved oct 2008. The insurance company have not been paid out by the third party for the repair on the car so there for will not release the 4 years no claims bonus they have took off us this is costing us an extra 200 per year on insurance and they just keep saying there is no update available

    Until they are paid in full, they won't alter your history, (which correctly now shows your claim).

    Are you sure the third party accepted liability (and was insured)? Who paid your excess?

    (And why have you lost all your 4 yeaes NCB? Did you make another claim during the year, as normally a claim results in the loss of 2 years NCB)
  • we had 7 years no claims and lost 4 years yes the third party was insured as through a company they admitted liability as have paid my partners personal injury claim just not paid the insurance company for the repair of our vehicle resulting in them not releasing our other 3 years no claims bonus

    we orignally paid the excess then the third party paid us back at the same time as the personal injury

    Usually the maximum NCB you are given is 5 years (even though you have driven 7 - or more - without claiming).

    So after one claim your NCB will correctly go down to 3 years.

    You don't say what happened about your excess - who paid that when the repairs were carried out? If you paid it, have you succeeded in recovering it from the third party?
  • You need to specifically ask what the delay is. Sometimes recovery of insurers outlay can be overlooked by them and you need to check they have presented the claim for their outlay. It is fairly unusual that insurers will dispute repair costs between themselves, so bearing in mind that the injury and excess have been recovered there should be no reason for the delay in them recovering the repair costs.

    It sounds like you are speaking to someone who is simply looking at the screen and telling you the claim is open and no change.

    Ask to speak to someone dealing with the 'recovery' of their outlay - sometimes this is called the 'recovery' or 'recoveries' department.
