Your prioroty is that charging order - can you pm 10past6 as s/he has been providing as massive amount of help to people on these recently. Once that is done get all the paperwork together so you can respond to requestd for info. Can you scan documents?
I have PM'd 10past6 as suggested but I am unable to scan documents. I await his/her reply.
ThanksWins in 2009: Kelly Clarkson CD0 -
OK can you photograph it and upload to www.flickr.com or similar. You only link to the page on here for a brief while when 10past 6 is on-line.
Find the termination document, the default document and start a new thread, with a link to this on, titled charging order
Then lay out the history of the account and type out the content of the default letter IF you cannot post it up anywhere.
maybe read tasha thread here as wellhttp://forums.moneysavingexpert.com/showthread.html?t=1445277If you've have not made a mistake, you've made nothing0 -
Hi
Can you scan those documents up please, for me to check them,Find the termination document, the default document
If you don't have access to a scanner, use a camera phone.
It's vital I view those documents.

Hi Fonay
As soon as I had my LBM I confided in my hubby and he's been great - given me cash to pay off the council tax. He couldn't believe that I hadn't told him before as he just assumed I handled the money side well - so after his initial disbelief he gave me a big hug and said we'd get through this together. I now tell him every day what is happening and we have drawn up a snowball calculator together and have agreed to stick a monthly update on our kitchen wall so we can see what progress we are making each month on reducing the debt. We aim to be debt free by Dec 2011, how about you?
I really hope that 10past6 can help with the tricky bits of your charging order.
The people on here are really great - the kind of advice we need to avoid being pushed into accepting unrealistic demands from our creditors.
I really would recommend if you have not already done so setting up an appointment with Payplan or CCCS - have a look at their websites.
All the best

Hi Fonay - howya doin? Haven't heard from you in a while?"I have enough money to last me the rest of my life, unless I buy something"0

Hi Kimdegsidash,
I'm doing ok. I've had a few responses from companies regarding my payment offer. So far they seem to be positive one company even sent us a paying in book with the correct amount of slips needed at the rate I offered.
The court has agreed to suspend the attachment of earnings order having seen my SOA and have agreed to implement our payment offer again. I'm just waiting for the councils bank details to set up a new standing order.
I have now got a Halifax bank account, which means I can now reset up any direct debits etc.
How are things going with yourself?Wins in 2009: Kelly Clarkson CD0 -

A few points with this are that:
1 - it is a pretty good estimate of everything I owe.
2 - I have 4 months of mortgage arrears
3 - The secured loan is on the car through logbook loans
4 - The direct debit for gas and electricity has been cancelled
5 - I have an attachment of earnings going through the system for the debt to the council. I would like to know how I can stop that as it could affect my job.
6 - I have a charging order against me for the Natwest debt. The date is set in Febuary.
I am absolutely, totally lost and this debt is now affecting my everyday working and family life. Any advice would be greatly appreciated.
Thank you,
First you need to look at DMP/IVAs, they will go through a financial statement like what you have done above. The areas highlighted in red im sure could be reduced and to warn you, DMP companies will question your luxeries and the creditors may not accept any offers while you have them to pay.0 -
Morning
How about the charging order? Have you been able to go through the documents with 10past6? Hope you get that one resolved too.
:T Well done for the progress you have made so far. Hope you had the chance to enjoy the snow with the kids this week. Nothing like a couple of snowballs in the face to take your mind off things!
I've sent letters this week to my creditors offering token payments for a couple of months till I get myself straight. Also had to write to my bank (RBS) as they messed me around with a direct debit for which have incurred a total of £64 in charges, for an £18 DD. Hope to sort that out Monday. Have also stepped up my reclaim of bank charges with Cahoot (an old account) due to financial hardship - asked for £450 back there. Also looking into claiming back the PPI I was sold with a mortgage 4years ago. :j
Unfortunately, both Capital One and Egg have increased the interest rate on my CCs this week - so now my snowball DFD is Feb 2012 instead of Dec 2011.
Anyhow, I'm really pleased you have made progress with your offer of lower payments. Might need your advice when my creditors start reacting!

Hi VanillaDelia,
Thanks for your reply.
Partners monthly income after tax....... 0 - needs to earning p/t - I work irregular shifts and therefore my wife is unable to work part time as she can't guarantee that I won't be working.
Telephone (land line)................... 45 try to cut it down to 30 - I have cut this down to £22.50
Mobile phone............................ 20 cut it down to £10, you have a landline - This was for two mobiles, my wifes and mine
Satellite/Cable TV...................... 45 this is a luxury, they may not allow it. - I understand the principle behind what your saying, however, my kids enjoy having their programmes as does my wife so I would call this something else if I had to. I have reduced it to £34
Groceries etc. ......................... 360 very high try cut back by £60 at least - We are trying
Clothing................................ 40 this should come into your groceries etc section - This was more for the kids shoes etc than for my wife and myself.
Petrol/diesel........................... 220 that is far to much, take a walk, bike - When I am working it is a 100 mile round trip and therefore taking a bike or walking is not an option.
Road tax................................ 20
Car Insurance........................... 54
Presents (birthday, christmas etc)...... 20 they dont give for these things, they are luxuries - Like I said with the sky, I will call this something else if I have to. I understand why I shouldn't be listing these things but there is no company I owe who is going to tell me I can't buy my family presents etc
Haircuts................................ 10 this comes under groceries etc.. - Why do they have this listed seperately if it comes under groceries etc? Or do you mean thats how the Debt management companies list it?Wins in 2009: Kelly Clarkson CD0 -

Morning,
I went to court yestrerday about the charging order. Their representitive was extremely helpful. The charging order stands, however, I disputed the total amount of the order and the judge has said that Natwest have to supply a full breakdown of the amount by the 26th Feb. I am really grateful for that as I beleive well over 50% is charges on the original debt.
I have had a few more replys from creditors and some have sent new standing order/direct debit forms.
British Gas took a £50 payment on both accounts and have agreed to fit pre-payment meters so I am waiting for them to arrange a installation date.
HOW did the RBS repsond to your query about the charges you incurred for one direct debit. Are Capital One and Egg able to increase interest like that?
