hi all,
well this is my 1st post on here and all replies appreciated.
this post is on behalf of my gf's mum, who has recently split with her lying, cheating ex. after paying of this mans debts (which run into many thousand) he has now taken the only bit of property of value, a moterbike which was bought by her but put into his name. all credit card recipts show this was paid by her but does she have a legal leg to stand on? we know this bike is currently at his new place but after contacting the police they say this is now a civil matter and to contact citezens advice. this guy has been planning this long before they split, as we have seen this bike sell on ebay today, to his new next door neighbour. as said any info greatfully recieved.

I'm not so sure.
She paid for the bike but put it in his name - so, was it actually a gift? If so, then I'm not sure of the law on this but it does seem to me that people are entitled to keep the gifts they are given.
I have lots of receipts for stuff I've bought, but none of it "belongs" to me as I gave the stuff to other people.
I think this will be a tricky one to sort out, legally ....sorry, but it probably ain't worth sweating over. But that rather depends on how much the bike is worth. Going to Court will cost more money!Warning ..... I'm a peri-menopausal axe-wielding maniac

Of course on the other note a solicitor might say she left of her own accord and therefore knowingly left everything behind.

He persuaded her that insurance would be easier for him and cheaper as he has ridden bikes before, so she put the bike in his name. The bike is worth over 3 and a half grand.

Even though she bought it for herself she would have to prove this. The scumbag ex will no doubt say that it was a gift and it will have to be proved otherwise.
Especially as all the evidence points to it being a gift:
1. Its in his name
2. She paid for it

I am assuming he is the registered keeper of the vehicle (its registered in his name).
The registered keeper isn't necessarily the owner of the vehicle. I checked with the DVLA and here is what they say -

However I should imagine she would need something to prove she is the legal owner which is difficult. Even with a reciept of purchase he could claim it was a gift as the other posters have said. She would have to take him to court which would cost money. Although if she won he could have to pay court costs BUT is he likely to pay even if she wins? If he doesn't she would then have to instruct court baliffs I believe which costs more money. Even if she does win and he's sold it he could be allowed to pay at amounts he can afford e.g. if he shows he has a low income £5 week ad infinitum.
In all honesty? I would say its a hard lesson learned.
How do I know? Don't ask
. Lets just say I did get to ask a solicitor's advice as I had legal aid for another matter and decided it wasn't worth pursuing. I live in my own little world. But it's okay. They know me here.0
